المستخلص: تعد نظرية الوضع من أهم النظريات المتصلة بالظاهرة اللغوية في شتى تشكلاتها، سواء أكانت نحوية أم صرفية أم صوتية، أم دلالية، وبما أن النظر الأصولي اعتنى بالشق الدلالي للغة، وبما أن الخطاب الشرعي هو خطاب ملفوظ تحمله اللغة التي لا تحدد معانيها إلا بضبط دلالتها المختلفة انطلاقا من المفهوم الوضعي، وهنا تكمن أهمية دلالة الوضع بوصفها إحدى المعاني المنوطة بتحديد الأحكام التعبدية، من هنا عالج هذا البحث ماهية الوضع وتقسيماته عند الأصوليين، ثم تقديم مقاربة شهاب الدين القرافي (684 هـ) لمصطلح الوضع بأنه لا ينتج عن استعمال واشتهار في معنى ما، وبالتالي فهو يتقيد بالوضع اللغوي ولا يجاوزه إلى أوضاع أخرى كالعرفي والشرعي وغيرها على خلاف جمهور الأصوليين.

Nous pouvons considérer la théorie de convention une des plus importantes théories attachée au phénomène linguistique dans ces différentes formes ,en grammaire ,morphologie , phonologie , et en sémantique .Dans le cas du discours juriste (charaa) est verbal, possède un support linguistique qu’il ne peut plus fixer sa signification selon le concept conventionnel; c’est ici que nous trouvions l’importance de la sémantique ,puisqu’elle nous guide vers la signification exacte des valeurs de la jurisprudence et, de là j’ai essayé dans ma thèse d’éclaircir le contenu du terme (wadhaa= convention) et ces partitions et ces suivis en usul fiqh , sans oublier de présenter les approches d’Al-qarafi envers ce terme qui n’a aucun sens et ne portera aucun fruit sans l’utilisation (istiaamel) successive qui dépasse le sens linguistique aux autres conventions (aoudhaa) juristes et orf ou autre.

The situation theory is one of the most important theories related to the linguistic phenomenon in its various forms, whether grammatical, morphological, phonemic, or semantic, and since the jurisprudential view took care of the semantic part of language, and since the legal discourse is a vocalized discourse carried by the language that does not define its meanings except by controlling its different connotations based on the positivist concept. Here lies the significance of the situation as one of the meanings entrusted with defining the devotional rulings; from here, this research deals with the nature of the situation and its divisions among the jurisprudents and then presents the approach of Shihab al-Din al-Qurafi (684 AH) to the term situation that it does not result from the use and fame of a certain meaning, and therefore it is bound by the linguistic situation and does not transcend it to other situations such as customary, legal and others, unlike the majority of jurisprudents.
