المستخلص: This research titled “jurists’ opinions for practical application of seeking origin medically and legitimately” tackles the practical application of seeking origin to approve descent. I mentioned the sayings of the prophet Mohammad (peace be upon him) and his pleasance of his honorable descent which declare that the son is of legitimate bed whereas embrace is for whore. This is what all companions (may Allah bless them) agreed upon. Seeking origin is for settling struggles, it is like a governor, witness or mufti and being Muslin is a condition to be acceptable. Then I stated jurists’ opinions concerning the most acceptable evidences. After that I mentioned the acceptability of depending on mother’s milk, na¬ture and features, or blood type and DNA, to distinguish descent especially during wars. This research is divided into three chapters each has sections: Chapter one: approving descent by seeking origin which has three sections: Section one: definition of seeking origin and descent linguisti¬cally and practically Section two: evidences for legitimacy of approving descent by seeking origin from the Holly Qura’an and sunnah. Section three: conditions of seeking origin and the practical ap¬plication. Second chapter: the excuse of approving descent by seeking or¬igin which has three sections: Section one: acceptability of seeking origin to approve descent. Section two: cases in which seeking origin is dependable or un- dependable to approve descent. Section three: append descent to two. Chapter Three: jurists’ sayings about seeking origin with evi¬dences which has three sections: Section one: sayings of Hanabilah, Shafia’yah and Malikiyah with evidences. Section two: sayings of Ahnaf with evidences. Section three: seeking origin medically with medical analyses. Lastly, I finished the research with a conclusion and some rec¬ommendations. dependable to approve descent. Section three: append descent to two.
