المستخلص: الشارع عند وضع أحكامه ورسم نظمه جعلها وسائل لمقاصد تقصدها وغايات تغياها، وعدم اعتبار المآل والنظر للأثر المترتب يعد من الأسهم الطاعنة في إقامة الحكم على وفق ما أراده الشارع، وعليه تجلت قاعدة "النظر في مالات الأفعال معتبر مقصود شرعا"، ومن آثار النظر باعتبار المآل تحقيق الأمن والاطمئنان لإقامة الأحكام، وترسيخ الروابط بين فئات المجتمع، ومن هنا حرصت الشريعة على تعميق الأواصر ونبذ الفرقة والخلاف المذموم، وجعلت النظر باعتبار المآل الوسيلة الآمنة وصمام الأمان لترسيخ السلم والعدل في المجتمع، وما ظهور أعمال العنف وانتشاره في المجتمع؛ إلا نتاج الجهل بالدين، واتباع الهوى، واعتناق أفكار الغلو والانحراف، ومشارب التدمير والإتلاف، والزيغ عن إقامة الشرع وفق مراد الشارع. وتتمثل أهمية الموضوع من أهمية دور اعتبار المالات في بناء التعايش السلمي ويظهر ذلك من خلال التأكيد على واقعية الشريعة في علاقتها بأحوال المكلفين ومراعاة استطاعتهم، واحتواء الاختلاف بينهم، وإبراز أصل اعتبار المالات صلاحية الشريعة للتطبيق عبر الأزمنة، على اختلاف العادات والأعراف وتجدد النوازل، فهو معيار الحكم على العصر والواقع وبه توزن المستجدات ونتائج الأفعال والتصرفات على ضوء المصالح والمفاسد، ويضمن من خلال العمل بأصل اعتبار المالات سلامة وعي الفقيه في فهم أحكام الشرع وتكييفها ومن ثم تنزيلها على واقع المكلفين، والتثبت من تحقق مقاصد الشريعة وتحقيق مناطات الأحكام. إن واقع المسلمين اليوم في حاجة ماسة إلى فقه المالات لترسيخ مفهوم التعايش السلمي وتقبل الاختلاف والتنوع، ولما يترتب عليه من آثار عملية تضبط الواقع الذي تنزل عليه الأحكام التي هي وسائل وضعها الشرع لتحقيق المقاصد والغايات التي تغياها، بعيدا عن الغلو والتعصب المذموم، ودراسة موضوع الفكر المقاصدي يمكن الإنسان من امتلاك ملكة التفكير والاستنتاج، والاستدلال والاستقراء والتحليل، والنقد والموازنة والاستشراف المستقبلي، وتجعله لا يقر لأي فكر أو اجتهاد بغير سلطان أو بغير برهان، ويمتلك أدوات البحث والمعرفة، وإمكانية النظر في المالات والعواقب. وتنطلق الأهداف من أهمية أصل اعتبار المآل ودوره في التعايش السلمي ونذكر منها: الحفاظ على ثوابت الأمة وأصولها أن يطالها التغيير والتحويل، والتلاعب والتبديل، لتتوافق مع ما جاء في الكتاب والسنة، وتجسيد صلاحية الشريعة لكل زمان ومكان مستوعبة الاختلاف نابذة الخلاف المذموم، و إحياء ما اندثر من الدين، وتخليص الشريعة مما علق به من شوائب الجهل والمحدثات، وأدران التعصب والضلالات، وبذلك يكون أصل اعتبار المآل سمة لهذا الدين القويم، وميزة لهذه الشريعة الغراء، وتصفية المفاهيم الشرعية الصحيحة من ضدها، مما يخالف فهم العلماء في الاستدلال والاستنباط، وتمحيصها وتحريرها، وترجيح المناسب منها، ومقاربة الوجهات وتسديد الاختلافات، إبراز محاسن الشريعة ومقاصدها لجميع فئات المجتمع الإسلامي؛ لتكون دعوة لهذا الدين، من خلال الصورة المشرقة للمفاهيم الصحيحة، التي تحقق الخير والعدل والصلاح والتعايش السلمي للبشرية قاطبة.
