الحمد لله والصلاة والسلام على أشرف خلق الله محمد بن عبدالله وعلى آله وصحبه ومن والاه وبعد. فإذ فلسفة العقوبات في الشريعة الإسلامية تقوم على حماية مصالح الجماعة من جهة وحماية المصالح الضرورية من جهة أخرى، فقد اهتم الإسلام بالمجتمع اهتماما بالغا، وأحاطه بسياج من الضوابط التي تكفل له الأمن والاستقرار، ولهذا شرعت التعازير المختلفة للجرائم التي لا تتناهى ولا يمكن حصرها، أو عدها، لذا لا بد من دراسة هذا الموضوع في ضوء الفقه والقانون اليمني، وأثرها في الحد من الجرائم التي يتعرض لها المجتمع، مع بيان صورة مجملة عن الجرائم التي يستحق مرتكبها التعزير، ومن أجل ذلك ارتأيت أن أكتب في هذا البحث الذي هو بعنوان: عقوبة التعزير وآثار تطبيقها على المجتمع في ضوء الفقه ورأي القانون اليمني. وتتضح أهمية البحث في بيان أحكام عقوبة التعزير وآثار تطبيقها، فهي مسألة متجددة بحسب المصلحة، وستكون دراستها في ضوء نصوص الشريعة الإسلامية وبيان آراء الفقهاء القدامى والمعاصرين ورأي القانون اليمني. ويستهدف البحث بيان مفهوم عقوبة التعزير وحكمها وأنواعها وآثار تطبيقها في المجتمع. منهج البحث: إن المنهج الذي أراه محققا لأهداف بحثي ومؤديا للغرض المقصود منه هو المنهج الوصفي، القائم على الاستقراء والتحليل.
All praise due to ALLAH Almighty and peace and blessings be upon the noblest person, Prophet Mohammed Bin Abdellah, peace and blessings be upon his companions and whoever owes them allegiances. The philosophy of punishment in Islamic Jurisprudence is based on protection of the societies’ necessary interests. Islam places importance for societies and it has made regulations that ensure its safety and stability. Thus, different ta’azeer punishments have been made for countless crimes (TA’AZEER is a light from of punishment). To this end, it is necessary to study the different ta’azeer punishments in light of the Islamic (Fiqih) and Yemeni law and the impact of the punishment on restricting crimes in societies. Further, this study sheds light on crimes that deserves ta’azeer punishments. Title: Ta’azeer punishment and the impact of its implementation on societies in the light of Fiqih and Yemeni law; a comparative study. The significance of the study stems from explicating the rules of ta’azeer punishment and the influence of implementing them. Ta’azeer punishment rules are renewing according to interests of societies. The study of the ta’azeer punishment in the present paper is based on scripts of Shari’a law and explaining the contemporary and preceding mullahs’ perspectives and Yemeni law. The study aims at exploring the concept of ta’azeer punishment, rules, types, and the impact of their implementation in societies. Methodology: The study follows a descriptive paradigm based on analysis and induction.
