|a شغلت ولا زالت الحريات العامة حيزا كبيرا من الدراسات الوطنية والدولية بسبب الانتهاكات التي تلحق بها نتيجة الحروب والتعسف في استعمال السلطة أو بدعوى الحفاظ على النظام العام واستتباب الأمن وغيرها من الأسباب، لهذا أقرت معظم التشريعات الدولية والداخلية مجموعة من الضمانات لممارسة الحقوق والحريات العامة أهمها وجود دستور الدولة كقيد على سلطانها، الفصل بين السلطات ومبدأ تدرج القوانين بهدف احترام المشروعية، إلا أن التمسك بمبدأ المشروعية في جميع الظروف قد يؤدي إلى عرقلة نشاط الإدارة وإصابتها بالجمود، كما قد يصل إلى حد تعريض أمن الدولة واستقرارها للخطر والتأثير سلبا على النظام العام وعلى سير المرافق العامة بانتظام واضطراد، لذلك تضطر السلطة إلى اتخاذ إجراءات غير عادية خلال الظروف الاستثنائية لمجابهتها كجائحة كورونا والتي ستمس لا محالة بحقوق وحريات الأفراد. في مداخلتنا هذه سنسلط الضوء على مدى تأثير هذه الظروف الاستثنائية على الحريات العامة في الجزائر خلال جائحة كورونا.

|b Public freedoms have occupied and continue to occupy a large part of national and international studies due to violations caused by wars and abuse of power or under the pretext of maintaining public order and security and other reasons, for this most international and internal legislation has approved a set of guarantees for the exercise of public rights and freedoms, the most important of which is the existence of the State Constitution as a restriction on its authority, the separation of powers and the principle of the inclusion of laws in order to respect legality, but adherence to the principle of legality in all circumstances may lead to Obstructing the administration's activity and instilling it, as it may amount to endangering the security and stability of the state and negatively affecting public order and the functioning of public facilities regularly and steadily, so the authority is obliged to take extraordinary measures during the exceptional circumstances of its confrontation, which will inevitably affect the rights and freedoms of individuals. In our intervention, we will highlight the impact of these exceptional circumstances on public freedoms in Algeria during the Corona pandemic.
