المستخلص: This research means identifying the idea of financial turmoil, which is one of the cases that requires a system to apply for the opening of some bankruptcy proceedings stipulated by the new Saudi commercial bankruptcy system, in addition to the cases of stumbles and bankruptcies, and the importance of identifying that idea as one of the new ideas that was not provided in the old system cancelled, and not even in bankruptcy laws in most Arab countries, so the study began by explaining the concept of financial turmoil to the debtor and distinguishing it from other similar terms. The government's policy of "eliminating the threat of violence and the threat of violence against women" is a major challenge for the government. Financial turmoil has not yet reached the stage of stumble, and then the question of assessing the availability of financial turmoil with which it is afraid to falter, in terms of who has the right to appreciate its existence or not, what criteria should be taken into account when assessing the availability of financial turmoil with which it is afraid to falter, and who is responsible for monitoring this estimate in the light of the provisions of the system and its executive regulations. يعني هذا البحث بتحديد ماهية الاضطراب المالي الذي يخشى معه التعثر المالي، والتي تعد إحدى الحالات المتطلبة نظاماً للتقدم بطلب افتتاح بعض إجراءات الإفلاس التي نص عليها نظام الإفلاس التجاري السعودي الجديد، إضافة إلى حالي التعثر والإفلاس، وتأتي أهمية تحديدها في أنها إحدى الأفكار الجديدة التي لم ينص عليها في النظام الملغي، ولا في قوانين معظم الدول العربية؛ لذا ابتدأت الدراسة ببيان مفهوم الاضطراب المالي للمدين، وتمييزه عن غيره، مثل الإعسار المالي، والتعثر المالي، والإفلاس، ثم تناولت أنواع الإجراءات التي نص عليها نظام الإفلاس، وميزت بين تلك التي يجوز افتتاحها بناء على توافر الاضطراب المالي الذي يخشى معه من الإفلاس، وبينت أنه لا يجوز طلب افتتاح إجراءات التصفية، والتصفية لصغار المدينين، والتصفية العادية، ويجوز في غيرها، ثم تناولت تقدير توافر الاضطراب المالي الذي يخشى معه من التعثر، من حيث من له حق تقدير وجوده من عدمه، وما المعايير الواجب مراعاتها عند تقدير توافر الاضطراب المالي، وما جهة الرقابة على هذا التقدير في ضوء النظام ولائحته التنفيذية.
