حاولنا في هذا البحث التعرف على المواد المخدرة والمؤثرات العقلية بأنواعها وصورها المختلفة سواء كانت مخدرات طبيعية أو مصنعة وغير ذلك من صور. ثم عرصنا التعريفات الفقهية المختلفة للمواد المخدرة والمؤثرات العقلية، ثم قمنا بمناقشتها وتحليلها، وهل تتفق مع واقع المادة المخدرة والمؤثر العقلي أم لا؟ ورأينا أنه لابد من وضع تعريف دقيق لماهية المادة المخدرة والمؤثر العقلي، وأن يكون هذا التعريف دقيقا، بخلاف التعريف القانوني الذي يجب أن يكون دقيقا وحاسما في التعريف بهما، احتراما لمبدأ الشرعية الجنائية، وهو بالفعل ما توصلنا إليه من خلال هذا البحث. ثم تناول البحث الركن المفترض في جنايات المخدرات والمؤثرات العقلية وتبيان عناصره وحدوده. ثم ناقش البحث الأحكام المتصلة بالركن المفترض في ضوء أحكام المحاكم العليا لإظهارها أمام المشتغلين بالقانون والقائمين عليه. ثم انتهى البحث إلى مجموعة من النتائج والتوصيات الهامة والتي يرى البحث ضرورة العمل على تنفيذها من جانب القائمين على التشريع في كل دولة.
In this research, we tried to identify narcotic substances and psychotropic substances of all kinds and their different forms, whether they are natural or manufactured drugs and other forms. Then we presented the different jurisprudential definitions of narcotic drugs and psychotropic substances, then we discussed and analyzed them, and are they consistent with the reality of the narcotic substance and the psychotropic substance, or not? And we thought that an accurate definition of what narcotic substance and psychotropic substance are, and that this definition should be accurate, unlike the legal definition, which must be precise and decisive in defining them, respecting the principle of criminal legitimacy, which is what we have already reached through this research. Then the research dealt with the supposed element in the crimes of narcotic drugs and psychotropic substances, and clarified its elements and limits. Then the research discussed the provisions related to the presumed element in light of the rulings of the higher courts in order to present them to those working in the law and those in charge of it. Then the research ended with a set of important findings and recommendations, which the research considers the need to work on implementing them by those in charge of legislation in each country.
