المستخلص: Technological and scientific development has led to the fading of classic contracts that have become somewhat incapable of keeping up with this development. Economic dealers have ended up creating new contracts that conform to the nature of various economic interests and the development they have led to. These contracts include the management contract, the Franchise contract, the transfer of the invoice, the lease credit contract, and the documentary credit contract, which were called business contracts. The Algerian legislator intervened in the phase of economic reforms in close periods and codified these contracts, whether within general rules or by special rules, while he left some others without being regulated.

أدى التطور التكنولوجي والعلمي إلى تلاشي العقود الكلاسيكية التي أصبحت عاجزة نوعا ما عن مواكبة هذا التطور، فتوصل المتعاملون الاقتصاديين إلى استحداث عقود جديدة تتوافق مع طبيعة مختلف المصالح الاقتصادية والتطور الذي آلت إليه وتمثلت هذه العقود في عقد التسيير وعقد الفرانشيز وتحويل الفاتورة وعقد الاعتماد الإيجاري وعقد الاعتماد المستندي والتي اصطلح عليها عقود الأعمال، وتدخل المشرع الجزائري في مرحلة الإصلاحات الاقتصادية في فترات متقاربة وقام بتقنين هذه العقود سواء ضمن القواعد العامة أو بقواعد خاصة بينما ترك البعض الآخر منها دون تنظيم.

Le développement technologique et scientifique a conduit à la disparition des contrats classiques devenus un peu impuissants face à ce développement Les transactions économiques ont conduit à l'élaboration de nouveaux contrats correspondant à la nature des différents intérêts économiques et au développement qui en a résulté: contrat de gestion, contrat franchise, transfert de la facture , contrat de crédit-bail et le, créditdocumentaire.
Le législateur algérien est intervenu au stade des réformes économiques à des périodes proches et a codifié ces contrats soit dans le cadre des règles générales, soit par des règles particulières, tandis que d'autres les ont abandonnés sans organizer.
