|f The obligation to obtain patient satisfaction in the medical treatment contract is one of the most important obligations incumbent upon the doctor. The doctor must obtain patient satisfaction before any therapeutic or surgical intervention. The failure of (obtaining) this satisfaction makes the doctor wrong and responsible for the risks of treatment even if he does not make the slightest mistake in doing it. \nSuch consent shall be issued by the patient or his representative legally if he or she is in a state that does not allow him to express his or her satisfaction, provided that such consent is free, informed, and legally considered. \nThe doctor's obligation to obtain the patient's satisfaction with treatment raises the question of who bears the burden of proof in case of alleged failure to implement this obligation, which the French judiciary has placed on the patient to apply the general rules of proof. \nThis article mainly demonstrates the concept of consent in the medical treatment contract and determines its legal system.\nThis abstract translated by Dar AlMandumah Inc. 2021

|a الالتزام بالحصول على رضا المريض في عقد العلاج الطبي يعتبر من أهم الالتزامات الملقاة على عاتق الطبيب، إذ من واجب الطبيب الحصول على رضا المريض قبل أي تدخل علاجي أو جراحي، وتخلف هذا الرضا يجعل الطبيب مخطأ ومسؤولا عن المخاطر المترتبة عن العلاج ولو لم يرتكب أدني خطأ في مباشرته. \nويصدر هذا الرضا من المريض أو من يمثله قانونا إذا كان في حالة لا تسمح له بالتعبير عن رضائه، شريطة أن يكون هذا الرضا حرا ومتبصرا ويعتد به قانونا. \nكما أن التزام الطبيب بالحصول على رضا المريض بالعلاج يثير مسألة من يتحمل عبء الإثبات في حالة الادعاء بتخلف تنفيذ هذا الالتزام والذي جعله القضاء الفرنسي على عاتق المريض تطبيقا للقواعد العامة في الإثبات. \nوينصب هذا المقال بشكل أساسي على تبيان مفهوم الرضا في عقد العلاج الطبي وتحديد نظامه القانوني.

|d L'engagement d'obtenir le consentement du patient dans le contrat de traitement médical est un des engagements les plus importants qui incombent au médecin. Il appartient au médecin d'obtenir le consentement du patient avant toute intervention de traitement ou chirurgicale. L'absence d'un tel consentement rend le médecin fautif et responsable des risques résultant du traitement même si aucune erreur n'a été commise. \nCe consentement est donné par le patient ou par son représentant habilité s'il n'est pas en état d'exprimer son consentement, à condition que ce consentement soit libre, éclairé et légalement valable. \nL'engagement du médecin d'obtenir le consentement du patient soulève la question du fardeau de preuve en cas d'allégation concernant l'absence d'exécution de ce consentement; que le droit français met à la charge du patient en application des règles générales de preuve. \nCet article définit principalement le concept de consentement dans le contrat de traitement médical et son régime légal
