|a هذا هو بحث ((الحكم الشرعي لمكافأة أعضاء المؤسسات الوقفية: دولة الكويت وقانونها نموذجا))، ويسعى البحث إلى بيان طبيعة علاقة المؤسسات الوقفية بممثليها في الشركات المساهم فيها، ومدى استحقاق ممثلي المؤسسات الوقفية المكافأة السنوية الممنوحة لأعضاء مجلس إدارة الشركات المساهم فيها أو التي كانت من مصارف الوقف، ومدى تأثير قانون الشركات الكويتي في بناء الحكم الشرعي. واعتمد البحث على المنهج الاستدلالي والاستنباطي بتحليل المعطيات القانونية والشرعية، والنظر في الاتجاهات الفقهية، والأدلة، ومناقشتها وفق الأصول والقواعد المرعية. ومما توصل إليه وبناء على اتساع مفهوم النظارة في الواقع العملي فإن تمثيل موظف الأمانة في مجالس إدارات الشركات التي تساهم فيها الأمانة يعتمد على طبيعة التعاقد، فإما أن يكون عقد وكالة بأجر أو بغير أجر وإما أن يكون عقد إجارة خاصة، وفي الحالتين إما أن تكون عضويته في الشركات ضمن توصيفه الوظيفي في تعاقده الأساسي مع الأمانة أو لا، وفي الحالتين كذلك إما أن تكون مساهمة الأمانة في رأس مال الشركة استثمارا لأموال الوقف أو مصرفا من مصارف الريع كعموم الخيرات مثلا في شركة تعليمية أو طبية، وعليه فإن حكم المكافأة لن يخرج من حالات ثلاث.

|b The research “The Islamic judgment of rewarding the members of Waqf: in Kuwait and Kuwaiti Law for instance” seeks to explain the kind of the relation of Waqf institutions with their representatives in the companies contributed by them and the extent of the representatives worth of Waqf Institutions are entitled to the annual bonus granted to the members of the company’s board of directors that contributed in it or the one that was from the Waqf banks. And the impact of the law of Kuwaiti Companies in the Islamic law structure. The research was based on the constructive and deductive approach by analyzing legal and Islamic legitimate data. And consideration of the jurisprudence directions and proofs and discuss them according to the principles and general rules. In conclusion, based on the broadened concept of Waqf managers in practical, the representation of Awqaf Public Foundation’s employee in the boards of directors of the companies that contribute by Awqaf Public Foundation depends on the kind of the contract. So, either the agency contract be a wage or non-wage or be a private contract. And in both cases either the employee’s membership in the companies include in his job description in his basic contract with the Awqaf Public Foundation, or not. Also, in both cases Either the contribution of the Awqaf Public Foundation in the capital of the company shall be an investment of the Waqf funds or a bank from income banks like general charity which is for example in educational or medical company. Therefore, the Islamic judgment of the reward will not step out of three conditions.
