إزاء التحول السياسي الذي شهده العراق منذ عام 2003، فقد صاحب ذلك ظهور مجموعة من الأفكار التي تتعارض وتلك التي كانت سائدة سابقا وهذه الفلسفات على مختلف أنواعها أريد تنظيمها في نصوص الدستور، وقد كان للتعليم الخاص نصيبه من ذلك، إذ تم تنظيم التعليم الخاص بمختلف أنواعه ولأول مرة في نصوص الدستور بكل ما يحمله التعليم الخاص من أهمية تتعلق بجانب حقوق الانسان وبجانب الفلسفة الاقتصادية وحتى السياسية للدولة، وبالأخص بعد تغير شكل الدولة العراقية من كونها دولة بسيطة التركيب الدستوري الى دولة مركبة ذات اتحاد فيدرالي، الذي يعرف عنه بأنه يستتبع تنظيمه بتوزيع الصلاحيات داخل الدولة مع ضمان حقوق المكونات القومية والدينية داخل الدولة الاتحادية، وهذا الحال له دلالة على هجر الدولة العراقية لفلسفة النظام الاشتراكي سياسيا واقتصاديا والاتجاه نحو الحرية السياسية والاقتصادية-اقتصاد السوق-ولكن باليات معتدلة، غير ان هذا التنظيم جاء في بعض مفاصله مشوبا بالقصور والنقص التشريعي وهو ما اثبتناه في البحث، ولعل في هذا ما يشكل عقبة في طريق نهوض التعليم العالي الخاص بالدور المأمول منه في المجتمع، ولذا عرضنا لهذه المشكلة الدستورية مع إيجاد بعض الحلول المقترحة لتطوير النصوص الدستورية ذوات العلاقة بالتعليم العالي الخاص، سواء كانت تلك النصوص مباشرة أم غير مباشرة ولكنها مؤثرة في مشكلة التنظيم الدستوري.
