المستخلص: تهدف هذه الدراسة تحليل السياق وتطور عودة المغرب إلى حظيرة أجهزة الاتحاد الإفريقي (لا سيما طلب عضوية ECOWAS ومنظمة تنسيق قانون الأعمال في أفريقيا OHADA)، من خلال دراسة الفرص المتاحة في المغرب للانضمام لهذه الأجهزة، ضمن أولا مشروع التعاون بين المغرب والبلدان أعضاء منظمة تنسيق قانون الأعمال في أفريقيا. وثانيا تقديم حالة الأمكنة للقوانين والتشريعات التي تحكم دينامية الشراكات بين القطاعين العام والخاص في المغرب ومدى أثرها على تنمية الاستثمارات في فضاء بلدان منظمة تنسيق قانون الأعمال في أفريقيا. وأخيرا تحاول الدراسة عرض بعض القيود والمعيقات التي تحول دون تحقيق الأهداف المتوخاة والسبل الكفيلة لتجاوزها في أفق تطوير حكامة استراتيجية للشراكة بين القطاعين العام والخاص في الاتحاد الأفريقي.

This study aims to analyze the context and the development of Morocco’s return to the fold of the organs of the African Union (in particular the request for membership of ECOWAS and the Organization for the Coordination of Business Law in Africa) (OHADA), by studying opportunities in Morocco to join these devices, within the framework of the project of cooperation between Morocco and the member countries of the organization, and second, to provide the status of the laws and legislation governing the dynamics of public-private partnerships (PPE) in Morocco and their impact on the development of investments in the space of organized countries to. Coordinate business law in Africa. Finally, the study attempts to present some constraints and impediments to achieving the objectives and ways to overcome them in the development of the strategic governance of the public-private partnership in the African Union.

Cette etude a pour objectif d`analyser le contexte et l'evolution du retour du Maroc dans le giron des organes de l'Union africaine (notamment la demande d'adhesion a la CEDEAO et a l’Organisation pour la coordination du droit des affaires en Afrique (OHADA), en etudiant les possibilites au Maroc de rejoindre ces instances dans le cadre du projet de cooperation entre le Maroc et les pays membres de l'organisation, et deuxiemement de faire 1'etat des lieux des lois et legislations regissant la dynamique des parrenariats public-prive (ppp) au Maroc et leurs impacts sur le developpement des investissements dans l'espace des pays membres de l'OHADA. Enfin, l'etude tente de presenter certaines contraintes et auxquelles se heurte la realisation des objectifs traces dans le but de les surmonter en vue de baitr une governance strategique du ppp dans le cadre de l'Union africaine.
