المستخلص: ما إن يشرع طالب الشريعة في تقصي جزئياتها وفقه أحكامها المتناثرة حتى يقف على جملة من الأحاديث النبوية الثابتة قد تشكل في ذهنه على ما تقرر عنده محكماً من معهود الشارع في مراده، ولربما قوي في قلبه هذا الإشكال حينما يقف على ما نقل عن بعض كبار فقهاء الأمة من رد أحاديث مخرجة في أصح الكتب بعد كتاب الله البخاري ومسلم كائنة في أعلى درجة الصحة قد قبلها جمهور السلف والخلف، ولما قلب النظر في أفراد علة هذا الرد وجد منها ذريعة منافاة مقاصد الشريعة بله اكتشف أن بعضهم كان ممن حقق القول في هذا العلم ومع ذلك أصل لهذا المسلك الغريب على جادة الأوائل. ومن ثم جاءت هذه الورقة في بحث هذه الإشكالية المركبة من جهة تأصيل بعض ما يضبط هذا المهيع من محكمات عاصمات، ومن جهة أخرى عنيت الدراسة في شطرها الثاني ببحث ما علق ببعض أحاديث الصحيحين من مشكل مقاصدي مع التركيز على نقد المخالف في خصوص موضوعنا، ثم ختمت بسرد أربع نتائج مهمة وتوصية.

As soon as the student of Sharia begins to investigate its parts and the jurisprudence of its scattered rulings, he will stand on a set of proven prophetic hadiths that may form in his mind according to what was decided by an arbitrator of the norms of the street in his desire, and perhaps this problem is strong in his heart when he stands on what has been quoted from some of the great jurists of the ummah Whoever responds to the hadiths produced in the most correct books after the book of God al-Bukhari and Muslim, which are at the highest level of correctness, were accepted by the majority of the predecessors and the backs, and when the consideration of the individuals of the reason for this response was reversed, it found an excuse that contradicts the objectives of the Sharia. I arrive for this strange lane on Al Awal Avenue. Then this paper came to discuss this complex problem, on the one hand, establishing some of what is controlled by this court from the arbitrators of capitals, and on the other hand, the study in its second part concerned an examination of what was related to some of the Sahihin’s hadiths regarding the problem of Maqasadi with a focus on criticizing the violator in regard to our topic, then concluded It lists four important findings and a recommendation.
