المستخلص: Certainement que tout le monde conteste que la Constitution est le document juridique le plus supérieur et principale dans l'état, émane d’une contrat entre le peuple, le propriétaire réelle du pouvoir ,et l'état ou le pouvoir constitué, pour consacre et garantir les droits et libertés qui sont protégés normalement sur cette constitution, à travers la mise en place du développement des institutions et organes juridiques, et le même document constitutionnel doit créer un organisme dont le devoir de surveiller toute violations des dispositions de la Constitution Dans le cadre de l'action législative ou réglementaire. Le control judiciaire dans les pays qui ont adopté la séparation des pouvoirs est le plus important système de contrôle face à la législature.

There is no doubt that the Constitution is the highest legal document in the State. It is like the contract between the people, the owner of the real authority, and the State, having the established authority. It enshrines and protects rights and freedoms by establishing and developing legal institutions and bodies that seek to protect those rights and freedoms guaranteed in the Constitution. The Constitution must also provide for the establishment of a body responsible for monitoring any violation of the provisions of the Constitution, whether within the framework of legislative or regulatory action. In countries that have adopted the system of separation of powers, judicial control is considered one of the most important tools of control in the hands of the judiciary in confronting the legislative authority.

لا ريب أن الدستور هو أسمى وثيقة قانونية في الدولة، وهو بمثابة العقد بين الشعب صاحب السلطة الحقيقية والدولة صاحبة السلطة المنشأة وهو الذي يكرس الحقوق والحريات ويحميها، عن طريق إنشاء واستحداث المؤسسات والهيئات القانونية، التي تسعى إلى حماية تلك الحقوق والحريات المضمونة في الدستور، كما يجب أن يتضمن الدستور على وجوب إنشاء الهيئة التي تكلف بمراقبة كل خرق لأحكام الدستور سواء في إطار العمل التشريعي أو التنظيمي وتعتبر الرقابة القضائية في الدول التي تبنت نظام الفصل بين السلطات من أهم أدوات الرقابة كأداة في يد السلطة القضائية في مواجهة السلطة التشريعية .
