|a من جملة الإصلاحات الاقتصادية التي تبناها المشرع الجزائري نجد تكريسه لمبدأ حرية للاستثمار الذي كان مقيدا في ظل للإيديولوجية الاشتراكية؛ حيث استحدث أجهزة مرنة لتأطيره وقدم ضمانات أخرى لتفعيله وحمايته. إلا أنه من الصعب الحديث فعليا عن حرية للاستثمار الأجنبي في الجزائر بسبب وجود بعض الضوابط والقيود التي تحد من هذه الحرية؛ كضابط النشاطات والمهن المقننة وضابط حماية البيئة، أما القيود فنجد قيد للاعتماد المسبق وقاعدة الشراكة وحق الشفعة والتي من شأنها التأثير في حجم الاستثمارات المستقطبة.
