المستخلص: إن أموال الوقف إنما وجدت لتنمى وتستثمر وليس لتجمد وتحجر؛ فلا بد من توظيف هذه الأموال لتحقيق الإيرادات الضرورية لسد نفقات حفظها وصيانتها ودفع نفقات القائمين عليها أولا، ثم إشباع حاجات الموقوف عليهم كمقصود شرعي ثانيا، وأخيرا الزيادة، إن أمكن ذلك، في إنمائها ثالثا. انطلاقا من تلك الاعتبارات، حرص قانون الأوقاف المعدل والمتمم على استجلاب الكثير من العقود والصيغ التثميرية الهادفة إلى استغلال واستثمار وتنمية الأملاك الوقفية، إلا أن صيغة الإيجار العادي بقيت هي الغالبة على مستوى الواقع العملي. ورغم أن عقد إيجار الملك الوقفي لا يختلف إجمالا عن إجارة غيره من الأماكن من حيث طبيعة العقد وأركانه وشروطه وأثاره، إلا أنه يستقل بمجموعة من الأحكام أملتها خصوصية الوقف واقتضتها مصلحته، وذلك طبقا لما تضمنه الفصل الثالث من المرسوم التنفيذي 98-381.

The endowment funds are found to be developed and invested, and not to be frozen and solidified. It is necessary to use this money to achieve the necessary revenues to meet the expenses of its preservation and maintenance and to pay the expenses of those in charge of it first, then satisfying the needs of those held accountable as a second legitimate aim, and finally increasing, if possible, in its development thirdly. Proceeding from these considerations, the amended and supplemented Endowment Law was keen to obtain many contracts and investment formulas aimed at exploiting, investing and developing endowment properties, but the regular rental formula remained dominant at the level of practical reality. Although the lease of the endowment property does not differ in general from the lease of other premises in terms of the nature of the contract, its pillars, conditions and effects, it is independent of a set of provisions dictated by the specificity of the endowment and necessitated by its interest, in accordance with what is included in Chapter Three of Executive Decree 98-381.
