This study is contrastive doctrinal study which aims at investigating Mohammad bin Al-Hassan’s choices which disagree with Aba-Hanifah in testimony issues within Abu Hanifah’s denomination or with regard to the three others denominations ( Al-Maliki, Al-Shafii and al-Hambali). The study consists of two chapters; the first provides a brief history about Al-Imam Abu Hanifah. It discusses his jurisprudence, doctrinal status and his method in doctrinal inferring. In addition, it provides a brief history about Al-Imam Mohammad Bin Al-Hassan Al-Shaybani and discusses his jurisprudence, doctrinal status and his method in doctrinal inferring which agrees in total with Abu Hanifah’s. It also shows how Mohammad Bin Al-Hassan’ typology in biography affects many topologists in their methods of classification in doctrinal And Arabic sciences. and the Doctrinal Choice, its definition, its validity and the related terms. The second chapter discusses points to the basis of the Doctrinal Choice with examples from the scientific heritage of Al-Imam Mohammad Bin Al Hassan Al-Shyabani, along with the practical appliance through investigating Mohammad Bin Al-Hassan’s choices which disagree with Abu Hanifah in testimony issues, the origin of dispute, and showing the Imams’ opinions, discussing them and showing which opinion is the most acceptable. Moreover, this study shows that Mohammad Bin Al- Hassan’s choices that disagree with Abu Hanifah were based on evidence and many of scholars agreed with him as well many disagreed with him too. This study shows Mohammad Bin Al-Hassan’s scientific brilliance and his juristic and fundamentalist place. |
