|a تتخذ طريقة الدفع بعدم الدستورية أمام القضاء صورة الأسلوب الدفاعي، الذي يرجئ نفاذ القانون لغاية نشره في الجريدة الرسمية، ومحاولة تطبيقه في إحدى القضايا المطروحة على القضاء، وهو ما أسس له المشرع الدستوري الجزائري بمناسبة التعديل الدستوري الجزائري الجديد، بموجب القانون رقم 16- 01 المؤرخ في 06 مارس 2016، وقبله بكثير في ذلك، التشريع الإسلامي، وعدة تجارب دستورية مقارنة، وفي انتظار صدور القانون العضوي المحدد لكيفيات وشروط ممارسة الدفع المنصوص عليه في المادة 188 من التعديل الدستوري الجزائري، وفق ما نصت عليه المادة 2015، نناشد المؤسس الدستوري الجزائري لوضع النموذج المصري نصب أعينه، باعتبار تجربته من أفضل التجارب في مجال الرقابة الدستورية بطريق الدفع أمام قاضي الموضوع، في مواجهة أي قانون أو لائحة قد تخالف أحكام المواد الدستورية، من طرف كل متقاضي ذو صفة ومصلحة تقيد بالميعاد – الأجل - القانوني وأثبت جدية ووجاهة دفعه، تلافيا لما قد ينجر عن التعسف في استعمال حق الدفع من تعطيل للعدالة القضائية المنشودة، مما يحقق موازنة بين معادلة توفير حماية حقوق المتقاضي من جهة، وضمان النجاعة القضائية من جهة أخرى.
