المستخلص: يعرف الفقه الدستوري نوعاً من القواعد يُطلق عليها المبادئ فوق الدستورية، أو المواد فوق الدستورية، أو المبادئ الدستورية العليا، أو القواعد المؤسّسة للدستور، أو المواد الحاكمة للدستور...إلخ وهي وكما يُعرفها الفقه قواعد دستورية تُعطى، بوصفها قواعد تمس قضايا كبرى ومصيرية، وذات أبعاد استثنائية في الدولة، وتتعلق بحقوق ومصالح ومستقبل كل فئات الشعب دون استثناء، حصانة استثنائية تجاه التغيير والتعديل، تفوق الحصانة التي تُعطى لغيرها من قواعد الدستور، بحيث يكون تعديلها أو تغييرها أو إيقافها، نتيجة تعديل الدستور أو تغييره أو تعطيله، أمرًا بالغ الصعوبة على السلطات الحاكمة. والسؤال الذي يطرح نفسه في هذا الصدد (ماهي القاعدة العليا؟)، هذا التساؤل والذي أثارت الإجابة عليه جدلاً كبيراً بين فقهاء ومفكري القانون الدستوري، وأرجعهم إلى دراسة فلسفة القانون نفسها. اذ أدى هذا الجدل إلى إحياء فكرة القانون الطبيعي العالمي وهل يمكن اعتباره أساس للقواعد العليا التي تأتي في قمة الهرم التشريعي في البلاد، هذا القانون النابع من الإرادة الإلهية أو من الطبيعة الإنسانية ذاتها ويفرض بدوره حتى على كاتبي الوثائق الدستورية وما يأتي في درجتها من قواعد. في الحقيقة هذا الجدل الذي يغوص بنا في فلسفة القانون ذاتها حول المبادئ فوق الدستورية تعريفها ونشأتها والذي ينقلنا بدوره إلى تحديد قيمتها بين الشرعية والمشروعية في البلاد بالإضافة إلى علاقته بالقيم الديموقراطية في مجتمع من المجتمعات هو سبب اختيارنا لهذا الموضوع للبحث فيه في هذ الورقة البحثية والتي نحاول فيها التعريف بالمبادئ فوق الدستورية والجدل القائم حولها ونماذج لها في الدساتير المقارنة، ثم نتعرض إلى شرعية ومشروعية هذه المبادئ وعلاقتها بالقيّم الديموقراطية في المجتمع.

Constitutional jurisprudence defines a kind of rule called the supra-constitutional principles, supra-constitutional articles, the supreme constitutional principles, the constitutive rules of the constitution, the articles governing the constitution, etc. As defined by jurisprudence, constitutional rules are given as rules that deal with major and crucial issues, Exceptional rights in the State, and which relate to the rights, interests and future of all categories of the population without exception, exceptional immunity to change and amendment, exceeds the immunity given to other constitutional rules, so that modification, modification or suspension of the Constitution, Pric the ruling authorities (What is the supreme rule?), This question, which raised a great controversy among the scholars and thinkers of constitutional law, and attributed them to study the philosophy of law itself. This debate led to the revival of the idea of universal natural law and whether it can be considered as the basis of the supreme rules that come at the top of the legislative pyramid in the country, this law stemming from the divine will or the nature of humanity itself and in turn imposes even on the authors of constitutional documents and the next level of rules. In fact, this debate that delves into the philosophy of law itself on the principles of supra-constitutional definition and its origin, which in turn brings us to determine the value between legitimacy and legitimacy in the country as well as its relationship with democratic values in a society is the reason why we chose this subject to research in this paper, In which the definition of supra-constitutional principles and the controversy surrounding them and their models in comparative constitutions, and then we are exposed to the legitimacy and legitimacy of these principles and their relationship to democratic values in society.
