المستخلص: يجري تبليغ الأشخاص الاعتبارين والخاضعين لنظام معين وفق نصوص مواد المرافعات المدنية والتجارية الكويتي. وبكون التبليغ بالإلصاق كإجراء يرتبه القانون، بموجبه ينتج التبليغ القضائي أثره، ويتم في الأحوال التي لا يجد فيها المحضر من يصح تسليم التبليغ إليه أو في حال امتناع أي شخص ممن يجوز تسليم التبليغ إليه غير المطلوب تبليغه عن استلام التبليغ، ورغم أهمية هذه الطريقة من طرق التبليغ لم ينظمها المشرع الكويتي. جعل المشرع النشر الملاذ الأخير للتبليغ وآخر وسيلة لإتمامه عندما يتعذر تسليمه وتستنفد السبل الأخرى لإجرائه دون طائل. كما سكت المشرع الكويتي عن تنظيم هذه الطريقة من طرق التبليغ. إن إتباع نظام التبليغ أو الإعلان بوسائل الاتصال الحديثة (الإلكترونية) لأوراق المرافعات يؤدي إلى تفادي فوات المواعيد الإجرائية وكذلك يؤدي إلى توفير الوقت لأن الإجراء الذي كان يقوم به المبلغ والوقت الذي يستغرقه في عملية التبليغ أو الإعلان قد أصبح بهذه الآلية الحديثة يمكن إنجازه بمجرد ضغطة على الحاسوب عبر شبكة الاتصالات. ورغم أهمية هذه الطرق من طرق التبليغ وأهميتها فإن التنظيم التشريعي لها جاء ناقصا مما يقتضي إعادة النظر فيه.

Legal persons subject to a certain system are notified according to the provisions of the Kuwaiti civil and commercial proceedings articles. The legislator made publishing the last resort for notification and the last way to complete it, when it is impossible to deliver it and other means of carrying it out are exhausted without success. The Kuwaiti legislator also remained silent about regulating this method of reporting methods. The adoption of the notification system or the notification by modern (electronic) means of communication for the pleading papers leads to avoiding missing procedural deadlines and also leads to saving time because the procedure that the reporter used to perform and the time it takes in the notification or notification process has become with this modern mechanism that can be accomplished once A click on the computer via the communication network. Despite the importance of these methods of reporting methods and their importance, the legislative organization for them was deficient, which requires reconsideration.
