المستخلص: إن هذا البحث يتمحور حول محاولة في بيان حالة التسلط في مرحلة إبرام العقد هو تنفيذه، حيث ينتج هذا التسلط من التفاوت في القوة بين أطراف العقد، فيكون في هذه العقود طرف قوي يفرض شروطه، وطرف ضعيف لا يقوى على فرض شروطه في مرحلة التفاوض وآثاره على مرحلة التنفيذ، وتتمثل واقعة التسلط في هذه المراحل بوضع ثمن غير عادل للسلعة أو الخدمة التي يحتاجها المستهلك أو الموزع، ويتمثل أيضا التسلط الاقتصادي في فرض شروط غير عادلة مثل شرط الإعفاء من المسؤولية، وكذلك الشروط التي تفرغ التزام المدين الأساسي من مضمونه ومحتواه الأساسي، وسوف يتطرق هذا البحث إلى فرض القضاء للرقابة المتقدمة والرقابة على مرحلة التنفيذ والتي يترتب على عدم مراقبتها أن تصبح مكلفة على طرف ومربحة لطرف أخر.

This research focuses on attempting to explain the state of dominance during the contract conclusion stage and its implementation. This dominance arises from the power disparity between the contracting parties, resulting in a situation where one party, the strong party, imposes its conditions, while the other, weaker party, is unable to assert its conditions during the negotiation stage and experiences its effects during the implementation stage. The incident of bullying in these stages is represented by setting an unfair price for the goods or services that consumers or distributors need. Economic dominance is also manifested through the imposition of unfair conditions, such as exemption from responsibility, as well as conditions that strip the debtor's basic obligation of its substance and fundamental content. This research will delve into the judiciary's role in imposing advanced supervision and control over the implementation stage.
