|a لقد أقر المشرع الجزائري في قانون الوقاية من الفساد ومكافحته على مجموعة من التدابير الوقائية، ومن أهمها ضرورة تحلي الموظف بمدونة أخلاقيات المهنة باعتباره إجراء وقائيا من حيث تفعيل المبادئ الدستورية والقانونية المتمثلة في الشفافية والنزاهة والكفاءة في شغل الوظيفة العمومية، كما أن تكريس القيم الأخلاقية للموظف له دور كبير في الوقاية من جرائم الفساد باعتبار الموظف الركن الجوهري والأساسي في جرائم الفساد. ولذلك يجب على السلطة السياسية في الدولة العمل على توعية الموظف بأخلاقيات المهنة والتنبيه بمخاطر جرائم الفساد، وهذا من خلال تفعيل الرقابة الإدارية سواء كانت مباشرة أو غير مباشرة، لأنها تعد من التدابير الوقائية فهي تساهم في الحد من هذه الجرائم.

|b In the law of the prevention and fight against corruption, the Algerian legislator has established a series of preventive measures, the most important of which is the necessity for practicing a code of profession ethics by employees since it is considered as preventive measures to activate legal and constitutional principles that are transparency, integrity and efficiency in the public service. In addotion, the reinforcement of the moral values of the employee has a great role in preventing corruption crimes since the employee is regarded as a mainelement of corruption crimes. Therefore, the political authority of the State must sensitize the employee to the duties of the profession ethics and to remind the dangers of corruption crimes, by activating the administrative supervision, whether direct or indirect, to adhere to the ethics of the profession as a preventive measure to reduce the spread of this type of crime.
