المستخلص: تمثل الأعمال اليتيمة مشكلة حقيقية سواء بالنسبة للمستفيدين أو بالنسبة لمؤسسات التراث الثقافي، خاصة تلك التي تقوم بعمليات رقمنه شاملة، فالأعمال اليتيمة هي الأعمال المحمية بموجب قانون الملكية الفكرية ولكن مالك الحق غير معروف أو لا يمكن الوصول إليه لسبب أو لآخر بعد إجراء خطوات البحث الدؤوب عن مالك الحق في العمل اليتيم. من هنا تبلورت مشكلة هذه الدراسة حول مفهوم الأعمال اليتيمة ومفهوم ومتطلبات البحث الدؤوب عن صاحب الحق في العمل اليتيم، بالإضافة إلى بيان موقع الأعمال اليتيمة بين الملكية الفكرية والملك العام، كما حاولت الدراسة استكشاف الوضع الدولي بشأن معالجة مشكلة الأعمال اليتيمة وإيجاد حلول للمشكلات التي تسببها تلك الأعمال، مع عرض نماذج دولية للتعامل مع المشكلة. اعتمدت الدراسة على المنهج الوصفي التحليلي لتحقيق أهدافها اعتمادا على محركات البحث للوصول إلى مجتمع الدراسة الذي تمثل في دراسة نموذجين دوليين للتعامل مع الأعمال اليتيمة، هما منصة Diligent search (البحث الدؤوب)، Orphan Works Database (قاعدة بيانات الأعمال اليتيمة) التابعان رسميا للبرلمان الأوروبي، وأثبتت الدراسة أن الأعمال اليتيمة تعد عقبة كبيرة بالنسبة للمكتبات التي تعمل على حفظ الإنتاج الفكري وإيصاله إلى المستفيدين، بالإضافة إلى وجود أدوات رسمية للتعامل مع مشكلة الأعمال اليتيمة مثل منصة البحث الدؤوب Diligent Search وقاعد بيانات الأعمال اليتيمة Orphan Works Database التابعان رسميا للبرلمان الأوروبي حيث تتيح القاعدة تسجيل معلومات مفصلة عن الأعمال اليتيمة.

Orphan works represent a real problem, both for the beneficiaries and for cultural heritage institutions, especially those that carry out comprehensive digitization processes, Orphan works are works that are protected under intellectual property law, but the copyright owner is unknown or inaccessible for one reason or another after taking steps to diligent search for Owner of the copyright to orphan work. From here the problem of this study crystallized on the concept of orphan works and the concept and requirements of the diligent search for the owner of the copyright to orphan work, in addition to clarifying the location of orphan works between intellectual property and the public domain, The study also tried to explore the international situation about solving the problem of orphan works and finding solutions to the problems caused by those works, also presenting international examples to deal with the problem. The study relied on the descriptive analytical method to achieve its goals depending on search engines to reach the study community, which was represented in the study of two international examples for dealing with orphan works, namely the Diligent Search platform , and Orphan Works Database which are officially affiliated to the European Parliament, The study proved that orphan works are a major problem for libraries that preserve intellectual production and communicate it to the beneficiaries, in addition to the existence of official tools to deal with the problem of orphan works, such as the Diligent Search platform and Orphan Works Database, which are officially affiliated with the European Parliament, the database allows Record detailed information about orphan works.
