المستخلص: هذا البحث: البوفيه المفتوح بدون ثمن أو بثمن ليس مساويا لثمن الأكلة المعتادة (دراسة مقارنة في الفقه الإسلامي) يدور حول حادثة جديدة تعارف الناس عليها في زماننا، ويهدف البحث إلى بيان الحكم الشرعي للبوفيه المفتوح إذا كان بدون ثمن، أو بثمن ليس مساويا لثمن الأكلة المعتادة، بأن كان أكثر من قيمتها أو أقل . ولمعرفة الحكم الشرعي للبوفيه المفتوح بدون ثمن ينظر إلى حكم الدعوة إلى طعام، وإلى حكم إباحة ما يؤكل من الطعام، وإن كان مجهولا، ففي البوفيه المفتوح بدون ثمن معنى الدعوة إلى طعام، إذا كان على سبيل الإكرام للضيوف المدعوين، وفيه معنى الإباحة؛ لأنه إباحة من صاحب الطعام للضيوف- مدعوين كانوا أو غير مدعوين، محتاجين كانوا أو غير محتاجين - عن طيب نفسه . ولمعرفة الحكم الشرعي للبوفيه المفتوح بثمن ليس مساويا لثمن الأكلة المعتادة، بأن كان أكثر من قيمتها أو أقل، ينظر إلى ثمن الأكل، إن كان أقل بكثير أو أكثر بكثير من ثمن الأكلة المعتادة والمغبون عالم بذلك، فيكون حكمه كحكم البيع أو الشراء إن كان الثمن رمزيا حالة كون المغبون عالما بذلك، وأما إن كان المغبون غير عالم بذلك، فيكون حكمه كحكم البيع أو الشراء إن كان الثمن رمزيا حالة كون المغبون بائعا أو مشتريا غير عالم بذلك. وسوف يتبع الباحث المنهج الاستقرائي حيث يستقريء المسائل المتعلقة بالموضوع من كتب الفقه، وما كتبه العلماء المعاصرون في مواقع الإنترنت، ويقوم بجمعها وتصنيفها، ثم يتبع المنهج الاستدلالي في بيان أقوال الفقهاء في حكم تلك المسائل وأدلتها، ويذكر الراجح من أقوال الفقهاء وسبب ترجيحه، ويبرز في الخاتمة نتائج البحث ويذيله بفهرس للمصادر والمراجع، وبالله التوفيق.

This research: the open buffet without a price or with a price that is not equal to the price of the usual meal (a comparative study in Islamic jurisprudence) revolves around a new incident that people are familiar with in our time, and the research aims to clarify the legal ruling for the open buffet if it is without price, or at a price that is not equal to the price of the meal. The usual, that it was more than its value or less. To find out the Islamic ruling on an open buffet without a price, look at the ruling on inviting food, and at the ruling on the permissibility of what is eaten, even if it is unknown. In an open buffet without a price, the meaning of an invitation to food, if it is as a way of honoring the invited guests, and in it is the meaning of permissibility; Because it is permitted by the owner of the food for the guests - whether they are invited or not invited, needy or not - on his own free will. In order to know the legal ruling on the open buffet with a price that is not equal to the price of the usual food, if it is more than its value or less, look at the price of the food, if it is much less or much more than the price of the usual food, and those who spoil it are aware of that, so its ruling is the same as the ruling on buying or selling if the price is symbolic. In the event that the aggrieved are aware of this, But if the aggrieved person was not aware of this, then his ruling is the same as the ruling on buying or selling if the price is symbolic in the event that the aggrieved person is a seller or purchaser who is not aware of it. The researcher will follow the inductive approach, where he infers issues related to the topic from books of jurisprudence, and what contemporary scholars have written on the Internet, and collects and categorizes them. Conclusion The results of the research and appended to it with an index of sources and references, and God grant success.
