المستخلص: عرفت منظومة الأحوال الشخصية في البلدان المغاربية تحولات جذرية لاسيما بالنسبة لقانون الأسرة الجزائري، الذي عرف عدة تعديلات جوهرية في مجال تنظيم العلاقات الزوجية أهما مسألة إدارة الشؤون الأسرية أثناء الزواج بعدما ألغى المشرع الجزائري فكرة القوامة في إطار تعديل 2005 من خلال إلغاء المادة 39 التي كانت تكرس مبدأ قوامة الزوج في إدارة شؤون الأسرة أثناء الزواج، لتحل محلها فكرة التشاور والتعاون والإدارة المشتركة للحياة الزوجية من خلال نص المادة 36 المعدلة. وهذا ما جسد إرادة المشرع الجزائري في إقحام الزوجة في مجال إدارة الشؤون الأسرية لاسيما في المسائل المتعلقة بالإنجاب وتربية الأولاد وتحمل المسؤوليات الناتجة عن إدارة الحياة الزوجية. مما يفرز الكثير من الإشكالات، أهما: التبعات التي تتحملها الزوجة في هذا الإطار وانعكاسات ذلك على مكانتها وحقوقها الزوجية لاسيما المالية منها من جهة؟. وأثر ذلك على استمرارية الحياة الزوجية من جهة ثانية؟. وعليه تأتي هذه المحاولة للوقوف على: - بيان فكرة القوامة من منظور الشريعة الإسلامية ودوافع إلغاءها ضمن تشريعات الأحوال الشخصية المغاربية أولا. - بيان مجالات إقحام الزوجة في إدارة الحياة الزوجية وانعكاسات ذلك على مركزها القانوني ثانيا. - أثر هذا التحول على المركز القانوني للمرأة أثناء الزواج. النتائج المترتبة على ذلك لاسيما بالنسبة: لتحمل مسؤوليات الحياة الزوجية واستمرارها.

The personal status system in the Maghreb countries has undergone radical transformations, especially with regard to the Algerian family law, which introduced several fundamental amendments in the field of regulating marital relations, the most important of which is the issue of managing family affairs during marriage after the Algerian legislator abolished the idea of guardianship within the framework of the 2005 amendment through the abolition of Article 39 which used to enshrine the principle of the husband’s guardianship in managing family affairs during marriage, to be replaced by the idea of consultation, cooperation and joint management of marital life through the text of the amended Article 36. This is what embodied the will of the Algerian legislator to involve the wife in the management of family affairs, especially in issues related to procreation, raising children, and bearing the responsibilities resulting from the management of marital life. It creates a lot of problems, most importantly: the consequences that the wife bears in this context and the repercussions of that on her position and her marital rights, especially financial ones on the one hand, and the impact of this on the continuity of married life on the other hand. Therefore, this attempt is made to find out: - First, a clarification of the idea of guardianship from the perspective of Islamic Sharia and the motives for its abolition within the legislations of Maghreb personal status first. - Second, a clarification of the areas of involving the wife in the management of marital life and its implications for her legal status. - The impact of this shift on the legal status of women during marriage.
