Le constituant algérien a organisé des mécanismes de contrôle constitutionnel (contrôle de la constitutionnalité des lois et contrôle judiciaire), visant à imposer l'état de droit aux dirigeants et aux gouvernés. Ce contrôle comprend le pouvoir réglementaire autonome exercée par le Président de la République en signant des décrets présidentiels, qui peuvent constituer un outil de dominance qu'il possède pour porter atteinte aux pouvoirs d'autres institutions, notamment le parlement et le premier ministre. Malgré le contrôle prévu sur le pouvoir réglementaire autonome du Président de la République conformément aux dispositions de la constitution, le système politique algérien confère à ce dernier une suprématie institutionnel qui affecte négativement l'efficacité de ce contrôle et l'affaiblit, qu'il s'agisse de contrôler la constitutionnalité des décrets présidentiels ou le contrôle judiciaire de ceux-ci.

The Algerian founder organized constitutional oversight mechanisms (the oversight of the constitutionality of laws and judicial oversight), aimed at imposing the rule of law on the rulers and the people. This oversight includes the independent regulatory authority exercised by the President of the Republic by signing presidential decrees, which may constitute a control tool he possesses to infringe on the competencies of other institutions, especially Parliament and the Prime Ministry. Despite the decision to monitor the regulatory authority of the President of the Republic in accordance with the provisions of the Constitution, the Algerian political system grants the latter an institutional advantage that negatively influences and weakens the effectiveness of this oversight, whether it is related to oversight of the constitutionality of presidential decrees or judicial oversight.
