La constitutionnalisation du principe de primauté du traité ratifié sur la loi a permis, de façon de plus en plus croissante, au droit international, essentiellement conventionnel, d’acquérir une place de choix au sein du système juridique algérien, battant en brèche les nombreuses critiques quant à son incompatibilité même avec le principe de la souveraineté nationale. Cette position du droit international dans l’ordre interne va se voir renforcée encore plus à travers l’intervention du juge et son rôle évolutif pour la mise en oeuvre des conventions internationales, plus particulièrement celles relatives aux droits et aux libertés, permettant ainsi la consécration d’un véritable Etat de droit. The constitutionalization of the principle of primacy of the ratified treaty over the law has increasingly enabled international law, which is essentially conventional, to acquire a prominent place within the Algerian legal system. defeating the many criticisms of its incompatibility with the principle of national sovereignty. This position of international law in the domestic order will be further strengthened through the intervention of the judge and its evolving role in the implementation of international conventions, more particularly those relating to rights and freedoms, thus allowing the consecration of a true rule of law. |
