المستخلص: أن الرقابة القانونية المباشرة لحماية القواعد الدستورية، تعد من اهم موضوعات القانون الدستوري، إذ يعد من الموضوعات المهمة التي تناولتها الدساتير بهدف الحفاظ على سمو الدستور من خلال منع خرق السلطة التشريعية للدستور، أي أنها الوسيلة الناجعة التي تكبح جماح السلطة التشريعية وتمنع غلوها على الدستور لأنها الجهة التي تراقب سلامة التدرج القانوني، وتحمي الديمقراطية عن طريق حماية الشرعية ومراعاة مبدأ المشروعية عن طريق التحقق من مخالفة القوانين للدستور تمهيدا لعدم إصدارها اذا كانت لم تصدر أو لإلغائها أو الامتناع عن تطبيقها اذا كان قد تم إصدارها واختلفت الدساتير في تبني أي نوع من أنواع الرقابة على دستورية القوانين فمنها من اخذ بالرقابة القضائية والبعض الأخر تبنى الرقابة السياسية على دستورية القوانين، وتناول موضوع الدراسة العوامل التي مهدت لظهور الرقابة الدستورية على القوانين وكذلك الإشارة إلى التجليات الفلسفية من خلال استعراض بعض التطبيقات الدستورية في مختلف الدساتير، ومدى رؤية تلك الدساتير ومدى تأثر الدساتير بموجة الحداثة التي شهدتها القوانين عموما، والدساتير على وجه الخصوص.
