المستخلص: يعد الاتجار بالبشر جريمة ضد الإنسانية لما ينطوي على عدوان صارخ على القيم الإنسانية والجماعات البشرية، إذ يجعل الأنسان سلعة ومحلا للعرض والطلب ويمكن تداولها واستغلالها بكافة الوسائل غير المشروعة وذلك بالمخالفة لتعاليم الأديان السماوية والقوانين والأعراف الدولية، ولذلك فان الاتجار بالبشر يخلف أثارا سيئة على الجوانب الإنسانية والأمنية والاجتماعية والنفسية والصحية للضحايا، وان انتشاره في الدول يجعل من هذه التداعيات ذات أثر سيئ على النظام العام في الدولة، في جميع عناصره التقليدية وغير التقليدية منها، وبما أن الإدارة هي الجهة المختصة بصيانة النظام العام بعناصره المختلفة (التقليدية منها وغير التقليدية) وإنها أيضا الجهة المسؤولة عن تنفيذ أحكام القوانين، لذلك فان من واجب الإدارة منع ومكافحة عمليات الاتجار بالبشر. تناولنا موضوع أساليب الضبط الإداري ودورها في منع عمليات الاتجار بالبشر في مطلبين، فأفردنا المطلب الأول لتعريف الضبط الإداري ووسائله، أما المطلب الثاني فدرسنا فيه دور وسائل الضبط الإداري في منع الاتجار بالبشر، وقد تبين لنا أن الإدارة تتخذ مجموعة من التدابير للحد من أعمال الاتجار بالبشر، فللحد من العمل القسري تعمل الإدارة على تنظيم العمل ووضع ضوابط يكون الهدف من التقيد بها، كفالة حقوق العمال والحيلولة دون استغلالهم، وتنظم الإدارة كذلك شؤون دخول العمال الأجانب وإقاماتهم، وتعمل على وضع الضوابط لمنع استغلال الأشخاص في الأعمال الطبية، فضلا عن واجبها في الحد من الاستغلال الجنسي، ومن اجل التصدي للطلب، ينبغي اتخاذ تدابير تستهدف أولئك الذين يستعملون أو يستغلون خدمات ضحايا الاستغلال، وينبغي أيضا تحليل العوامل التي تؤدي إلى الطلب، وهذه العوامل ليست متشابهة في جميع صور الاستغلال، ولذلك يجب النظر في عوامل زيادة الطلب في كل شكل من أشكال الاستغلال على حدة، فعوامل الطلب على السخرة والعمل القسري تختلف عن الاستغلال الجنسي وغيرها. وقد توصلنا من خلال بحثنا إلى مقترحات عدة قد يكون أهمها معالجة عدم وجود قرارات تنظيمية وحمائية لحقوق العمال العراقيين والعمال المهاجرين، وأهمية النظر في وضع أحكام واضحة تنظم عمل شركات الاستقدام والتوظيف، وتحديد المؤهلات المطلوبة في العامل الأجنبي، فضلا عن تنظيم عمل خدم المنازل.
