يتناول البحث الحق في استخدام كاميرات المراقبة وأثره على الحق في الصورة، فالعصر الحديث يشهد توسعاً ملحوظاً في استخدام كاميرات المراقبة، حيث يتجه العديد من الأفراد والشركات والمؤسسات وأصحاب المحال إلى استخدامها نظراً لما تحققه من المزايا الأمنية أو التنظيمية. ولكن على الرغم من أهمية استخدام كاميرات المراقبة إلا أن هذا الاستعمال قد يمس بشكل مباشر الحقوق والحريات الأمر الذى يترتب عليه قيام مسؤولية المستخدم التقصيرية، وذلك متى تم استخدامها على نحو مخالف للغرض من استخدامها، كاستخدامها في الاعتداء على حرمة الحياة الخاصة للغير، أو على حقه في الصورة، لذلك فإن خطة البحث تم تقسيمها إلى مبحث تمهيدي أتناول فيه المقصود بكاميرات المراقبة وأهميتها، وفصلين الأول يتناول ضوابط استخدام كاميرات المراقبة، والثاني يعالج أثر استخدام كاميرات المراقبة على الحق في الصورة، وانتهت الدراسة إلى نتائج وتوصيات من أهمها ما يلى: - أنه يمكن التعدي على الحق في الخصوصية والحق في الصورة باستخدام كاميرات المراقبة، إلا إذا تم استخدامها فيما يحقق المصلحة العامة. - أوصى المشرع المصري بوضع قانون ينظم استعمال كاميرات المراقبة.
The research deals with the right to use surveillance cameras and its effect on the right to the image, as the modern era is witnessing a remarkable expansion in the use of surveillance cameras, as many individuals, companies, institutions and shop owners tend to use them due to the security or regulatory advantages they achieve. Therefore, the research plan was divided into an introductory topic in which I dealt with what is meant by surveillance cameras and their importance, and the first two chapters dealt with the controls of the use of surveillance cameras, and the second deals with the effect of the use of surveillance cameras on the right in the picture, and the study ended with results and recommendations, the most important of which are the following: - It is possible to infringe on the right to privacy and the right to photograph by using surveillance cameras, unless they are used in the public interest. - The Egyptian legislature recommended drawing up a law that regulates the use of surveillance cameras.
