المستخلص: "يتناول البحث مسألة في باب القضاء في ظل نازلة معاصرة، هذه المسألة من مقتضيات التطور التقني في العصر الحديث وهي التقاضي عن بعد عبر وسائل التواصل الإلكتروني، والنازلة هي فيروس كورونا، وقد جعلت عنوان البحث «التقاضي عن بعد في ظل انتشار جائحة كورونا». وقد تناولته في مقدمة وثلاثة مباحث؛ فالمقدمة ذكرت فيها أهمية البحث وأهدافه ومشكلته والدراسات السابقة عليه ومنهجه وخطته، ثم تناولت المبحث الأول وعرفت فيه بالتقاضي عن بعد وفيروس كورونا، ثم ذكرت في المبحث الثاني بعض الأمور المتعلقة بالقضاء عند الفقهاء من حضور المتداعين والحكم على الغائب والصفات التي ذكرها الفقها للمجلس القضائي، ثم انتقلت إلى المبحث الثالث وذكرت فيه حكم القضاء عموما عند الفقهاء وأدلة مشروعيته، ثم تناولت مسألة التقاضي عن بعد في ظل انتشار وباء كورنا وجواز العمل بهذا النظام تفاديا للعدوى بالفيروس. وقد توصلت من خلال بحث هذه المسألة عدة نتائج منها أن الشريعة الإسلامية صالحة لكل زمن ومكان، وأن للقواعد الفقهية دور كبير في بيان الحكم الشرعي في مسائل النوازل، وأن الأحكام الشرعية جاءت لتحقيق المقاصد الشرعية الضرورية والحاجية والتحسينية، وغير ذلك، ثم ختمت البحث بخاتمة بينت فيها أهم ما توصلت إليه من نتائج، ثم ذكرت بعض التوصيات."

The research deals with an issue in the door of the judiciary in light of contemporary conflict. This issue is one of the requirements of technological development in the modern era, which is remote litigation through electronic means of communication, and the downfall is the Corona virus, and has made the title of the research "remote litigation in light of the spread of the Corona pandemic". It was covered in an introduction and three sections; The introduction mentioned the importance of the research, its objectives, its problem, the previous studies, its methodology and its plan, then dealt with the first topic and knew about it in remote litigation and the Corona virus, and then mentioned in the second topic some matters related to the judiciary of the jurists from the presence of the defendants and the judgment on the absent and the qualities that the jurisprudence mentioned to the Judicial Council, then I moved to the third topic and mentioned the ruling of the judiciary in general among the jurists and the evidence of its legitimacy, then dealt with the issue of remote litigation in light of the spread of the Corona epidemic and the permissibility of working with this system in order to avoid infection with the virus. Through researching this issue, I reached several conclusions, including that Islamic Sharia is valid for every time and place, and that the jurisprudential rules have a great role in explaining the Sharia ruling in issues of calamities, and that the Sharia rulings came to achieve the necessary, necessary and ameliorative legal objectives, and so on. Then I concluded the research with a conclusion that showed It contains the most important results that it reached, and then mentioned some recommendations.
