المستخلص: قسمت البحث إلى تمهيد، وثلاثة مباحث، وخاتمة مضمنة أهم النتائج والتوصيات؛ وقد أظهرت أثر الفتوى من خلال اتباع ضوابط الفتوى في النوازل؛ والسير على وفق إجراءاتها فيها، وما خلصت إليه من ترجيح يمثل ما ستكون به الفتوى في رأي الباحث. فأما التمهيد؛ فتناولت فيه تعريف الفتوى، وأهميتها. وفيما يلي ذكر المباحث: المبحث الأول: ضوابط الفتوى والتنزيل؛ وفيه ثلاثة مطالب؛ الأول: ضوابط الفتوى، والثاني: ضوابط المفتي؛ والثالث: ضوابط تنزيل الفتوى. المبحث الثاني: ضوابط الفتوى في النوازل المعاصرة وأثرها في فقه الأسرة؛ وفيه مطلبان؛ الأول: ضوابط الفتوى في النوازل المعاصرة، والثاني: أثر ضوابط الفتوى على النوازل المعاصرة في فقه الأسرة. المبحث الثالث: دراسة تطبيقية على نوازل معاصرة من فقه الأسرة؛ وفيه أربعة مطالب؛ الأول: مسألة تلقيح الأجنة صناعيا. والثاني: مسألة استئجار الرحم. والثالث: مسألة الزواج العرفي. والرابع: مسألة النكاح الصوري. وختمت البحث بخاتمة ذكرت فيها أهم النتائج والتوصيات. ومصادر البحث، وفهرس الموضوعات الرئيسة في البحث.

The research is divided into an introduction, three sections, and a conclusion that includes the most important results and recommendations. I showed the effect of the fatwa by following the controls of the fatwa in the calamities; And proceeding according to its procedures in it, and the weighting I concluded from it represents what the fatwa will be in the opinion of the researcher. As for the preamble; It dealt with the definition of fatwa, and its importance. The following is mentioned by the detectives: The first topic: Fatwa and download controls; It contains three demands; The first: the controls of the fatwa, and the second: the controls of the mufti; The third: the rules for downloading the fatwa. The second topic: Fatwa controls in contemporary calamities and their impact on family jurisprudence. It has two requirements; The first: the controls of the fatwa in contemporary calamities, and the second: the impact of the fatwa controls on contemporary calamities in the jurisprudence of the family. The third topic: an applied study on contemporary calamities of family jurisprudence. It contains four demands; The first: the issue of artificial insemination of embryos. The second: the issue of renting the womb. The third: the issue of customary marriage. And the fourth: the issue of sham marriage. The research concluded with a conclusion in which the most important results and recommendations were mentioned. And research sources, and index of the main topics in the research.
