|a لقد اتسعت دائرة نشاطات الشخص المعنوي اليوم بشكل لافت، حيث لم تعد عمليات الإنتاج والتوزيع والبيع بيد الشخص الطبيعي، بل بيد شركات ضخمة مهمتها تحقيق الربح وبأية وسيلة إضرارا بصحة المستهلك عن طريق المتاجرة بمواد غذائية مغشوشة. كان لابد عندئذ من إقرار المسؤولية الجزائية للشخص المعنوي التي ظهر بشأنها جدل فقهي كبير بين مؤيد ومعارض، أما تشريعنا الوطني فلم يأخذ بالمسؤولية الجزائية للشخص المعنوي ولم يستبعدها في العديد من النصوص القانونية إلى أن جاء تعديل قانون العقوبات لسنة 2004، حيث أقر المسؤولية الجزائية للشخص المعنوي في حالة الغش في المواد الغذائية بتوافر شروط معينة متبوعة بجزاءات عقابية.
|b The circle of activities of the legal person has considerably expanded today, as production, distribution and sale operations are no longer on the hands of the natural person, but on those of huge companies whose mission is to make profit by all means, including trading in Cheated foodstuffs, harming the consumer health. Thus, it was necessary to establish the criminal liability of the legal person which was the subject of great jurisprudential controversy between supporters and opponents. However, our national legislation did not take into account the criminal liability of the legal person and did not exclude it from many of legal texts, until the amendment of the Criminal Code in 2004, which stipulated the criminal liability of the legal person in the event of cheating in foodstuffs by providing certain conditions followed by punitive sanctions.
