المستخلص: الهدف من دراسة قاعدة الإجماع السكوتي عند الأصوليين وما بني عليها من فروع فقهية: تأصيل هذه القاعدة ببيان ماهيتها وحقيقتها بيانا شافيا، مشفوعة ببيان شروطها، وصورها ثم بيان مذاهب الأصوليين التي زادت على عشرة، مبينا الراجح منها بالدليل، وهو أنه إجماع وحجة تبنى عليه الأحكام الشرعية، وهذا مذهب الأئمة الراشدين وعلى رأسهم مؤسس مدرسة الأصول على طول الزمان في جميع الأمصار، إمامنا الإمام الشافعي — طيب الله ثراه — ومن توقف في حجيته على شرط خاص به فما أراه إلا مذهبا ضعيفا مردودا، ليظل المذهب المقبول هو مذهب جمهرة العلماء القائلين بأنه حجة وإجماع. ووصيتي لطلاب هذا العلم العظيم أن يجعلوا منها موسوعات شاملة لكل مذهب على حدة حتى يعلم القاصي والداني على حد سواء مدى أهمية هذه القاعدة دراسة نظرية وعملية، وحسبنا أن الإجماع أداة الوحدة والقوة حتى يعم الخير المجتمع الإنساني كله، وما ذلك على الله بعزيز.

The objective of studying the rule of silence in fundamentalism and the jurisprudential branches on which it was built is to firmly establish this rule by making a clear statement of what it is and what it really is, together with a statement of its conditions, which it portrayed and then a statement of the fundamentalist sects that have exceeded ten, indicating the most likely point with evidence, that it is a consensus and an argument upon which the Islamic rulings are based. This is the doctrine of the Adult Imams, at the head of whom is the founder of the School of Origins all times. Imam Al-Shafei- Taieb Allah Thara- and whoever stopped in his argument on a condition of his own, what he saw as a weak and restive doctrine, so that the accepted doctrine remains the doctrine of the Jamahiriya of the scholars, who say that it is an argument and a consensus. And my recommendation to the students of this great science is to make of it encyclopedias that are comprehensive for each sect, so that the extreme and the religious alike may know the importance of this rule in theoretical and practical study. We thought that consensus is the tool of unity and power so that good may prevail in all human society, and that it is not hard on God.
