|a يرتبط منع القتل بالحفاظ على حياة الناس، وهو الذي أقرته الشريعة. وقد يكون القتل عن أمر ينفذه المأمور لتحقيق غرض شخصي؛ فالبحث مهم من هذا الجانب، دفعني إلى تناوله وقوعه بكثرة فما هي أحكام الآمر والمأمور كليهما من الناحية الشرعية؟ وجوابا على هذه الإشكالية سلكت منهج الوصف مع التحليل، وقسمت البحث إلى ثلاثة مباحث: الأول في أحكام الآمر بالقتل، والثاني في أحكام المأمور به، والثالث في أحكام المشارك فيه. ومما خلصت إليه: أن الآمر بالقتل بغير حق قاتل آثم، ويقتص منه على رأي الجمهور، وكذا من أكره غيره عليه، وكذا المأمور بشرط أن يكون عاقلا بالغا مختارا للقتل مباشرا غير مشارك له فيه غيره. وتقتل الجماعة إذا اشتركت في قتل الواحد فيجب القصاص على جميعهم.
|b Preventing murder is linked to preserving people's lives, and it is established by Sharia. The killing may be from an order carried out by the warden to achieve a personal purpose; The research is important from this aspect, which prompted me to deal with it in abundance. In answer to this problem, I followed the method of description with analysis, and divided the research into three sections: the first in the provisions of the order to kill, the second in the provisions of the commanded, and the third in the provisions of the participant. And from what I concluded: that the one who ordered the unlawful killing is a sinful murderer, and he will be punished according to the opinion of the public, as well as the one who forces others to do so, and the same is the case with the one who is ordered to be a sane, adult, chosen to kill directly without anyone else participating in it. The group shall be killed if it participated in the killing of one, so retribution shall be imposed on all of them.
