|a في إطار التغييرات الكبيرة التي أحدثها التعديل الدستوري لسنة 2016 في سبيل إحداث توازنات بين مؤسسات الدولة واستقراره، فقد تم الاستجابة للتوصيات المطالبة بإعطاء دور أكبر لمجلس الأمة في مجال الوظيفة التشريعية، معلنا قفزة نوعية في تحقيق ديمقراطية تشاركية حقيقية، وهو ما عززه وأكد عليه المؤسس الدستوري الجزائري من خلال التعديل الدستوري الأخير لسنة 2020. فبالعودة إلى أهم نتائج هذه الورقة البحثية نجد أن المؤسس الدستوري أقر للغرفة الثانية في تعديل 2016 و2020 بحصرية المبادرة بالنص القانوني في مجالات محددة تمثل مجال المبادرة التشريعية لمجلس الأمة، وهذا بعدما كان مبعدا ومقصى من المبادرة التشريعية للاعتبارات السابق ذكرها والمتمثلة في: الإقصاء نتيجة لتعارض مواد الدستور وكذا الإقصاء نتيجة للمبررات التقنية، غير أن السلطة التي أقرها المؤسس الدستوري لأعضاء مجلس الأمة في مجال المبادرة بالتشريع جاءت غير مطلقة، فقد أحاطها المؤسس الدستوري الجزائري بجملة من القيود التي ترد عليها.
