|a اللغة هي بوتقة الأفكار وهي أداة للتعبير عنها وبمعنى آخر أن المفاهيم التشريعية والآراء الخاصة بالقانون يتم التعبير عنها عن طريق اللغة سواء كانت معاني أم ألفاظا أم مباني وجملا، ولأن فهم التشريع القانوني والإحاطة بمعانيه ومقاصده وأهدافه يكون عن طريق معرفة اللغة العربية وإتقانها، لأن التشريع يتمثل في قواعد موضوعة في مبادئ موضوعية وقوالب لغوية في إطار لغوي، لذلك يكون إتقان القائمين على وضع النصوص التشريعية القانونية للغة العربية أمرا ضروريا ولاسيما إذا علمنا أن هناك بعض القواعد اللغوية يتخذها والمباني)، وعلى الرغم من أهمية النصوص القانونية في حياتنا إلا أنها لم تنل نصيبها الكافي من البحث فلهذه النصوص الأثر المباشر في حياة الأشخاص الطبيعية والمعنوية. لذلك ومن أجل الإحاطة بالموضوع قسمنا البحث على مبحثين خصص الأول منهما لدراسة النص والجملة عند القانونيين واللغويين، أما ثانيهما فسنبين فيه الأمر عند القانونيين واللغويين.
