تعد مباحث العام والخاص من جليل مباحث علم الأصول، لما تعطيه للباحث، ولذا حققت هذه القواعد المصلحة ودفع المفسدة، وتأتي هذه الدراسة محاولة لعرض قاعدة "العام لا يختص بسببه" كإحدى القواعد الأصولية المتعلقة بمباحث العام والخاص، وبيان أدلتها، وتحليلها، والتطور الاستدلالي للأدلة. واشتملت الدراسة على مقدمة ومبحثين وخاتمة، وخصص المبحث الأول: للتعريف بقاعدة "العام لا يختص بسببه"، والثاني: لبيان حجية القاعدة، وأدلتها والتطور الاستدلالي للأدلة. واتبعت في هذه الدراسة المنهج الاستقرائي التحليلي، حيث تم استقراء أدلة الحنفية في القاعدة من خلال الكتب المحددة، ثم تحليلها وبيان متى بدأ الاستدلال بالدليل ومتى توقف، وهل طرأ على الدليل تطور في هيئته خلال مدة الاستدلال به. وخلصت الدراسة إلى: أن قاعدة العام لا يختص بسببه من القواعد المتفق على حجيتها عند الحنفية، وقد نصوا على ذلك صراحة في أكثر من موضع، وقد استدل الحنفية على أن العبرة لعموم اللفظ لا لخصوص السبب بأربعة أدلة منها دليل نقلي، ومنها استدلال بأصل اللغة، ومنها الاستدلال بالمعقول، كما يلاحظ أن عدد الأدلة التي استدل بها الحنفية رحمهم الله لهذه القاعدة -مما وقفت عليه- أربعة أدلة: الاستدلال بالإجماع، وبأصل اللغة، ودليلان من المعقول. ويلاحظ أن الأدلة التي استدل بها للقاعدة في الأغلب لم يطرأ عليها تغيير كبير، ويلاحظ دور الجصاص في التأصيل والتأسيس للقاعدة حيث ابتدأ الاستدلال بدليلين، والبزدوي بدليل واحد، وانفرد الصيمري بدليل، وفي هذا يظهر تنوع العصر الذي بدأ فيه التأسيس الاستدلالي للقاعدة، حيث ابتدأ في القرن الرابع وانتهى في القرن الخامس من الهجرة النبوية، ويلاحظ أن الدليل الرابع لم يكن له متابعات، وتوقف الاستدلال به عند من ابتدأه، كما يلاحظ عناية علماء الحنفية رحمهم الله بهذه القاعدة، حيث بلغ عدد المتابعات في إيراد الأدلة لمن ابتدأها لمجموع الأدلة خمس وأربعون متابعة.
