المستخلص: يعد العلم بالقرار الإداري ضرورة مهمة للغاية وذلك لتحديد ميعاد الطعن بالقرار الإداري، وهذا العلم يكون عبر العديد من الوسائل مثل نشر القرار الإداري ومن خلال إعلان ذوي الشأن وأيضا من خلال ما يسمى العلم اليقيني للقرار الإداري، وهذا الأخير مناط البحث دائما ما تثير إشكاليات حين الطعن بالقرارات الإدارية بدعوى الإلغاء وخصوصا إذا لم يتم نشر أو إعلان القرار الإداري فتلجأ إليه الإدارة لإثبات علم من وجه بحقه القرار الإداري لإثبات العلم بمضمون القرار الإداري وهو ما يفيد في رفض دعوى الطعن بإلغاء القرار الإداري إذا ما تجاوز من وجه بحقه القرار المدة اللازمة للطعن بمشروعية هذا القرار.

Knowledge of the administrative decision is a very important necessity in order to determine the date for appealing the administrative decision, and this knowledge is through many means such as publishing the administrative decision and through the announcement of the stakeholders and also through the so-called certain knowledge of the administrative decision, and the latter is the focus of research that always raises problems when appealing In the case of administrative decisions claiming cancellation, especially if the administrative decision has not been published or announced, then the management mechanism is used to prove the knowledge of the person against whom the administrative decision was directed to prove knowledge of the content of the administrative decision, which is useful in rejecting the appeal to cancel the administrative decision if the person against whom the decision was directed exceeds the period required to challenge the legality of this the decision.
