المستخلص: يتلخص هذا البحث في بيان القواعد القانونية الجزائية الإجرائية التي استند إليها المشرع السوري في تنظيم المحاكم المختصة بالجرائم الإلكترونية وجرائم الاتصالات، حيث ازدادت أهمية هذه القواعد في ظل الحرب التي تمر بها الجمهورية العربية السورية حيث كثر ارتكاب الجرائم الإلكترونية من خلال الشبكة العنكبوتية، مما دعا المشرع إلى سن قانون خاص بهذه الجرائم من خلال سياسة تجريمية وعقابية تتلاءم مع طبيعة هذه الجرائم. ولم يكتف بذلك، بل أنشأ محاكم مختصة بمحاكمة مركبي هذه الجرائم، ولذلك فإن دراسة السياسة الإجرائية لمكافحة هذه الجرائم لا نقل أهمية عن دراسة السياستين التجريمية والعقابية، وإن ذلك يتم من خلال دراسة القانون رقم 9 لعام 2018 الخاص بتشكيل محاكم متخصصة للجرائم المعلوماتية وجرائم الاتصالات.

Cette recherche consiste dans lʹexplication de règles pénales procédurales auxquelles le législateur syrien organize des tribunaux compétents aux infractions électroniqes et aux infractions de communication dans la mesure où lʹimportance de ces tribunaux augmente dans la crise syirienne. Lʹ influence dʹ internet dans cette crise apparaît de manière que les infractions électronique et les infractions de communications font une grande augmentation. Pour cela, cette étude sur la création des tribanuax spécifiqus pours les cyber infractions par la loi 9/2018 est très important car lʹexamen de la politique procédurale nʹ est pas moins importance de la poiltique punitive.

This research summarises the procedural criminal legal rules the Syrian lawmaker uses in regulating the courts of cybercrime and communications offences. The importance of these rules has increased in light of the war that the Syrian Arab Republic is going through as cybercrimes have increased over the Internet. This has prompted the lawmaker to enact a special law for these crimes through a criminal and penal policy that suits the nature of these crimes. It has not only done so but has established courts specialised in prosecuting perpetrators of these crimes. Therefore, studying the procedural policy to combat these crimes is no less important than studying the criminal and penal policies. This is done by studying Law No. 9 of 2018 on forming specialised courts for information and communications offences. This abstract was translated by AlMandumah Inc.
