|a الهدف من البحث: الوصول لحكم طلب وتولي المناصب والوظائف عند الفقهاء، مع استنباط المقاصد المرجوة من ذلك حلا أو حرمة. منهجية البحث: نقلت وقارنت بين المذاهب الفقهية الأربعة، مع الاستدلال والتعليل لكل قول، مع المناقشة والترجيح، وأذكر اختيار وترجيح المحققين من أهل العلم في المسألة. ذكرت المقاصد الشرعية التي رعاها الشارع في المسألة المدروسة. أبرز النتائج: • طلب المناصب تختلف فيه المقاصد والنيات. • اختيار الموظف والمسؤول للوظيفة والمنصب يجب فيه مراقبة الله واعتبار المصلحة العامة وأن يوافق قصد المكلف قصد الشارع. • مقصد الشريعة من الولايات هو حفظ الدين والدنيا. • من مقاصد الناس في طلب المناصب والوظائف نصرة الدين وقد يقصد بذلك كسب المال، أو يقصد المباهاة، أو يقصد أن يكون مكان غيره أو معه، وكل واحدة من هذه المقاصد لها حكم فيما إذا طلبها.
