المستخلص: يهدف البحث إلى حصر المسائل الفقهية التي فرق فيها بين ذوي الأقدار وبين غيرهم، وبيان أن ذلك من محاسن الشريعة، واستخدم الباحث المنهج الاستقرائي المقارن، وذلك بتتبع تلك المسائل في كتب الفقهاء، وذكر أقوالهم ومناقشتها، وبيان الراجح ووجهه، وقد توصل إلى نتائج أهمها: أن المقصود بذوي الأقدار أصحاب الجاه واليسار، والمنزلة، ومن عرفوا بالصلاح والخير، وفي معناهم ذوي المروءات وذوي الهيئات، وأن إقالة ذوي الأقدار في الزلات، والعفو عنهم في بعض الأحكام بخلاف غيرهم ثابت في الشرع، وأن الفقهاء راعوا ذوي الأقدار في بعض المسائل، وجمع الباحث سبع مسائل متفرقة في أبواب النكاح والقضاء، والتعزيرات، ومن أبرزها: مسألة: إخدام الزوجة إن كانت من ذوي الأقدار، فالراجح أنه يراعى في ذلك العرف والعادة، فإن جرت العادة أن الزوجة ممن يخدم مثلها، وكان الزوج موسرا، فيجب عليه إخدامها وإلا فلا، ومسألة: إكراه ذوي الأقدار على الطلاق، فالراجح أنهم إذا أكرهوا على الطلاق فلا يقع الطلاق، بخلاف غيرهم، وفي التعزيرات أن ذوي الهيئات إن صدر منهم ما يوجب التعزير، وكان ذلك لأول مرة، فعلى الحاكم مراعاتهم بما فيه المصلحة، بخلاف غيرهم.

Divorce takes place, unlike others, and in the reprimands, if those with bodies issued what necessitates a reprimand, and that was for the first time, then the ruler must take them into account in what is in the interest, unlike others.
