يهدف هذا المقال إلى تسليط الضوء على حق الأشخاص في وضعية إعاقة في العمل بالمغرب على اعتبار أن المغرب من الدول السباقة للمصادقة على الاتفاقيات الدولية ذات الصلة بحقوق هذه الفئة. فقد فرض الثقل الديمغرافي المتنامي لهذه الفئة (15% من ساكنة العالم) بالإضافة إلى تزايد الوعي المجتمعي بقضايا وإشكالات الإعاقة على الفاعلين السياسيين والاقتصاديين والمدنيين التفكير في مداخل لتمكين هذه الفئة من المساهمة في التنمية والاستفادة العادلة من ثمارها دون تمييز. ولم يكن المغرب في معزل عن هذه الدينامية العالمية حول إقرار حماية لهذه الفئة التي تبلغ حوالي 2.264.672 شخصاً حسب نتائج البحث الوطني حول الإعاقة لسنة 2014، ولعل الوقوف على تقييم مدى مطابقة الممارسة المغربية في مجال حماية حق هذه الفئة في العمل والنهوض به للمعايير الدولية لحقوق الإنسان، سيتم، في شق أول، رصد وتمحيص نطاق انخراط المغرب في الدينامية الحقوقية الدولية لحماية هذا الحق والنهوض به وكذا إبراز السياقات الداخلية والخارجية المساهمة في ذلك. في حين سيتم، في شق ثاني دراسة مجالات ترجمة تعهدات المغرب الدولية في هذا الإطار من خلال فحص نطاق الاعتراف الدستوري والحماية القانونية والمؤسساتية وكذا إبراز حدود العناية والاهتمام بحماية هذا الحق والنهوض به من خلال البرامج الحكومية والسياسات العمومية والقطاعية.
This article aims to shed light on the right of persons with disabilities to work in Morocco, given that Morocco is one of the first countries to ratify international conventions related to the rights of this category. The growing demographic weight of this group (15% of the world's population), in addition to the increasing societal awareness of disability issues and problems, forced political, economic, and civil actors to think of ways to enable this group to contribute to the development and benefit equitably from its fruits without discrimination. Morocco was not isolated from this global dynamic regarding the adoption of protection for this group, which amounts to about 2,264,672 people, according to the results of the national research on disability for the year 2014. Perhaps to assess the extent to which Moroccan practice conforms to the protection and promotion of the right of this group to work with international standards. For human rights, in the first part, the scope of Morocco's involvement in the international human rights dynamic to protect and promote this right will be monitored and scrutinized, as well as the internal and external contexts that contribute to this. While, in the second part, the areas of translating Morocco's international commitments in this context will be studied by examining the scope of constitutional recognition and legal and institutional protection, as well as highlighting the limits of care and concern for the protection and promotion of this right through government programs and public and sectoral policies.
