المستخلص: يبرز لنا هذا البحث بياناً توضيحياً لقاعدة مقاصدية بعنوان "الترجيح بأدوم المصلحتين نفعاً دراسة مقاصدية تطبيقية"، بشرح القاعدة وبيان علاقتها بالقواعد القريبة منها، وبيان معايير الترجيح بها، ثم يجلي البحث التأصيل الشرعي للقاعدة متعرضاً في ثنايا ذلك إلى أنواع الأدلة وتقسيمها إلى عامة وخاصة، ثم يُعطف عنان البحث إلى بيان تطبيقات القاعدة في الفروع الفقهية، وهي حكم التعارض بين أنواع الصدقة، واستثمار أموال الزكاة، وحكم التعارض بين زواج المرأة ودراستها في الجامعة، وذلك وفق المنهج الوصفي التحليلي، وقد توصل الباحثان إلى مقتضى العمل بالقاعدة حال تساوت المصالح رتبة ونوعاً، وتعذر الجمع بين الأنفع والأقل نفعاً فيلجأ إلى الترجيح بالأدوم نفعاً، وتحديد النفع الأدوم يكون إما بالديمومة أو التعدي أو الامتداد الزمني، على وفق قاعدة النظر في مآلات، وقد ساهمت القاعدة في معالجة جملة من الفروع الفقهية.

This research highlights to us an explanatory statement for a Maqsid rule entitled “The weighting of the two interests is more beneficial, an applied purpose study Abstract:”Study of Maqasid and its Applications to Jurisprudential Branches By explaining the rule and explaining its relationship to the rules close to it, and clarifying the criteria of weighting with it, then the research shows the legitimate rooting of the rule, exposed in the folds to the types of evidence and its division into general and specific, Anan then turns the research to a statement of the applications of the rule in the branches of jurisprudence, which is the ruling on the conflict between the types of charity, the investment of zakat funds, the ruling on the conflict between a woman’s marriage and her studies at the university, and the ruling on, according to the descriptive analytical approach, The two researchers have reached the requirement to work with the rule if the interests are equal in rank and quality, and it is not possible to combine the most beneficial and the least beneficial, so he resorts to giving preference to the most beneficial, and determining the most permanent benefit is either by permanence, transgression, or time extension, according to the rule of looking at problems, and the rule has contributed to addressing the sentence From the branches of jurisprudence.
