إن الوجود الواقعي لنظم تكنولوجيا المعلومات أصبح امرا مفروضاً علينا، بل أنه أفرز لنا ظهور وانتشار التعاقد عبر الإنترنت أو العقد الإلكتروني بصفة عامة، ثم ظهور ما يسمى بالعقد الإداري الإلكتروني بصفة خاصة، وعليه يتضح أن العقود الإدارية الإلكترونية تكمن خصوصيتها في طرق وأساليب إبرامها. وعليه تبين أن انتشار شبكة المعلومات عبر الإنترنت بصفة عامة، ومن استخدامها في تيسير وإدارة المرافق العامة، وما نتج عنها من مشاريع الحكومة الإلكترونية في غالبية دول العالم ومنها الكويت ومصر وفرنسا، فقد أدى إلى تحديث وتطوير أساليب إبرام العقود الإدارية. ولذلك ولأهمية أساليب إبرام العقود الإدارية الإلكترونية، فقد تم بحث الأساليب التقليدية والحديثة لإبرام هذه العقود في هذه الدراسة.
The de facto presence of information technology systems has become something that is imposed on us. Rather, it has given us the emergence and spread of the contract via the Internet or the electronic contract in general, and then the emergence of the so-called electronic administrative contract in particular. Therefore it becomes clear that electronic administrative contracts whose specificity lies in the ways and methods of concluding them. Accordingly, it became clear that the spread of the information network via the Internet in general, and its use in facilitating and managing public utilities, and the resulting e-government projects in most of the countries of the world, including Kuwait, Egypt and France, has led to modernization and development of methods for conclusion of the administrative contracts. Therefore, due to the significance of the methods of concluding the electronic administrative contracts, traditional and modern methods of concluding such contracts were discussed in this study.
