|a لما كانت العلاقة الزوجية تحدث أثارا مالية فقد خصصت مدونة الأسرة لسنة 2004 المادة 49 منها لتنظيم الأموال المكتسبة أثناء قيام الفترة الزوجية، إذ حاول المشرع من خلال هذه المادة وضع إطار قانوني للنظام المالي للزوجين للتخفيف من حجم النزاعات المالية التي قد تنشا بين الزوجين سواء أثناء قيام العلاقة الزوجية أو عند انتهائها، وبالتالي ضمان الحماية القانونية للحقوق المالية لمكونات الأسرة والحفاظ عليها وتنميتها بما من شأنه أن يضمن استقرار الأسرة وازدهارها. غير أن عمومية المادة 49 من م أ طرحت العديد من الإشكاليات القانونية والعملية نتج عليها تضارب قضائي مهم، ولعل من أبرز هذه الإشكاليات نجد مسألة التصرف في الملكية العقارية المشاعة (المشتركة) بين الزوجين. فإذا كان التصرف في الملكية العقارية المشاعة بصفة عامة تخضع لمجموعة من القواعد المنظمة في قانون الالتزامات والعقود ومدونة الحقوق العينية بما يضمن مصلحة جميع الشركاء في الملك المشاع، وبما أن المادة 49 من م أ جاءت عامة وغير مفصلة فإن هذه القواعد السالفة الذكر هي الأولي بالتطبيق على التصرف الوارد على الملك المشاع الزوجين، غير أن السؤال الذي يثار في هذا الصدد، هو مدى ملاءمة هذه القواعد العامة لنظام الاشتراك بين الزوجين في ظل الخصوصية التي تفرضها طبيعة العلاقة التي تجمع بين الزوجين؟؟
|b Since the marital relationship brings financial consequences, the Family Code of 2004 devoted Article 49 of it to regulate the money acquired during the marital period. Through this article, the legislator tried to establish a legal framework for the financial system of the spouses to reduce the amount of financial disputes that may arise between the spouses both during the establishment of the marriage. The marital relationship or upon its termination, thus ensuring the legal protection of the financial rights of the components of the family and their preservation and development in a manner that would ensure the stability and prosperity of the family. However, the generality of Article 49 of A.D. raised many legal and practical problems that resulted in an important judicial conflict, and perhaps the most prominent of these problems is the issue of disposing of the common (shared) real estate property between the spouses. If the disposal of communal real property in general is subject to a set of rules regulating in the Law of Obligations and Contracts and the Code of Real Rights in a manner that guarantees the interest of all partners in the common property, and since Article 49 of the aforementioned is general and not detailed, these aforementioned rules are the first to be applied to The behavior of the common property between the spouses, but the question that arises in this regard is the suitability of these general rules to the system of participation between spouses in light of the privacy imposed by the nature of the relationship that brings together the spouses??
