المستخلص: إيمانا من المشرع المغربي بأهمية مواكبة حجم التحولات التكنولوجية المعاصرة التي تعرفها الساحة الوطنية والدولية، عمل على سن مستجدات تشريعية حديثة من شأنها مواجهة التحديات والمخاطر التي قد تطرحها هذه التطورات خاصة ما يرتبط بميدان التصرفات القانونية وما قد تخلفه من مشاكل ونزاعات أمام القضاء حول طرق فض هذه النزاعات وآليات ذلك، ما دفع المشرع المغربي إلى وضع نظام حديث للإثبات المدني يساوي بين الوثيقة الورقية والوثيقة الإلكترونية في الإثبات وفي الحجية ويحقق الأمن والتوقع القانونيين، ويضمن الثقة في القضاء من خلال سن قانون 53.05 المتعلق بالتبادل الإلكتروني للمعطيات القانونية والذي خلف تأثير عميق على نظرية الالتزام وعلى نظام الإثبات المدني. وعليه وارتباطا بكل هذا فإن موضوع تأثير التحول الرقمي على نظام الإثبات المدني موضوع يطرح العديد من الإشكالات المرتبطة أساسا بإبراز حدود ومظاهر تأثير هذه التطورات على نظام الإثبات المدني، أيضا إبراز مكامن مدى إسهام هذه المستجدات في تحقيق العدالة واستتباب الأمن القانوني والقضائي.

Believing in the importance of keeping pace with the scale of contemporary technological transformations that the national and international arena is witnessing, the Moroccan legislator worked on enacting modern legislative developments that would confront the challenges and risks that these developments may pose, especially those related to the field of legal actions and the problems and disputes that may arise before the judiciary about ways to resolve these developments. Disputes and the mechanisms of this, which prompted the Moroccan legislator to develop a modern system of civil proof that equalizes the paper document and the electronic document in proof and authenticity and achieves legal security and expectation, and ensures confidence in the judiciary through the enactment of Law 53.05 related to the electronic exchange of legal data, which has had a profound impact on the theory of commitment And on the civil evidence system. Accordingly, and in connection with all this, the issue of the impact of digital transformation on the civil evidence system is a topic that raises many problems related mainly to highlighting the limits and manifestations of the impact of these developments on the civil evidence system, as well as highlighting the extent to which these developments contribute to achieving justice and establishing legal and judicial security.
