يهدف البحث إلى محاولة رسم حد فاصل بين الأملاك العامة والخاصة العائدة للإدارة نظراً للخلط الكبير الحاصل بينهما، كما يحاول البحث أن يبين الأوضاع التي تملك الإدارة العامة تعظيم إيراداتها من أملاكها الخاصة من خلال ببيعها أو تأجيرها أو إتاحة استعمالها للأفراد بعقود أو قرارات إدارية (تراخيص) لقاء مقابل ليس برمزي وإنما مساو للمقابل المتعارف عليه بين أفراد القانون الخاص، كما لا يقف البحث عند هذا الحد بل يتعداه ليعرفنا على آخر التطورات القانونية في بلاد القانون المقارن وتحديداً (فرنسا) وكيف ميزت بين نوعي الأملاك وكيف أتاحت أمام الأفراد - كشاغلين للأملاك الخاصة وسيلة الانتفاع من تلك الأملاك.
