|a يهدف البحث التعرف على حكم إجبار الولي المرأة على النكاح اعتمدت في الدراسة على المنهج الاستقرائي وتوصلت الدراسة إلى عدة نتائج أهمها 1- إنه لا يجوز للولي إجبار المرأة الثيب او البكر البالغة العاقلة على الزواج إلا بإجازتها 2- إن من ذهبت بكارتها بزنا أو وثبة وتعنيس فحكمها حكم البكر في جواز الإجبار من عدمه 3- للولي إجبار المجنونة على النكاح سواء كانت بكرا أم ثيبا وبناء على هذه النتائج فقد أوصت الباحثة بضرورة 1- العمل على رفع مستوى الوعي لدى العائلات حول سلبيات الزواج القهري من خلال عقد برامج وندوات والتأكد من وصولها لكل شرائح المجتمع 2- وضع قوانين رادعة لكل الأطراف المشتركة في اتمام هذا الزواج من حبس إلى الغرامة المالية كما هو مطبق في بعض الدول.
|b The research aims to identify the ruling on forcing a woman’s guardian to marry The study relied on the inductive method. The study reached several results, the most important of which are 1- It is not permissible for a guardian to force a sane, adult, virgin, woman to marry without her permission 2- If a woman loses her virginity by fornication, jumping, and blasphemy, then the ruling on her is the ruling of a virgin regarding the permissibility of coercion or not. 3- The guardian may force the insane woman to marry, whether she is a virgin or a young woman Based on these results, the researcher recommended the necessity of 1- Working to raise awareness among families about the negative aspects of forced marriage by holding programs and seminars and ensuring that they reach all segments of society. 2- Establishing deterrent laws for all parties involved in the completion of this marriage, from imprisonment to a financial fine, as is applied in some countries
