المستخلص: اعتنى هذا البحث ببيان أثر اختلاف الرواة في رواية الحديث النبوي من قوله أو من فعله صلى الله عليه وسلم، من خلال بيان تطبيقات المحدثين على عدد من الأحاديث في الفرق بينهما في باب الاستدلال، متبعة المنهج التحليلي والنقدي في دراسة الحديث، واعتنى البحث بدراسة الأحاديث التي وردت من طريق الصحابي نفسه مرة من قوله صلى الله عليه وسلم ومرة من فعله، والتي أعل العلماء ورودها من قوله أو فعله صلى الله عليه وسلم ، مع بيان الأثر الفقهي لكل اختلاف، وكان من نتائج البحث التأكيد على أن إعلال المرفوع القولي بالمرفوع القولي، والعكس، مسلك معروف مشهور عند أئمة النقد، ولهذا الاختلاف إنما يكون له أثر وثمرة في فقه الحديث، حينما يكون القول بلفظ الأمر الذي يقتضي بظاهره الوجوب، فيحتاج لترجيح بين الوجوه.

This research focuses on clarifying the effect of difference between narrators in the narration of the prophetic hadith, either for sayings or actions of the Prophet (PBUH) through applications of hadith scholars on several hadiths them, concerning the differences between them in the section of ratiocination approaching the critical analytical method in studying hadith. Moreover, this research also focuses on considering hadiths narrated on the authority of the same prophet companion, once from a speech and another describes an action of the Prophet (PBUH) in which scholars established hidden defects concerning either of them, clarifying the Islamic jurisprudential effect of such difference. The most important results of the research include establishing hidden defects of the al-Marfu’ al-Qawli (speech attributed directly to the Prophet) by al-Marfu’ al-Fi’li (action attributed directly to the Prophet) and vice versa, which is a well-known and common approach followed by senior critics. This difference will effective and fruitful in hadith jurisprudence, when speech is in the form of order that’s ostensibly means obligation, then weighting different opinions.
